Rules: CT must prove CC has privided misinformation. CC must prove CT wrong.

Up for the challenge CT? I've got my chin out. Take the first shot and show me a post I made Re: MAME & Foley that contains what you think is misinformation. If I can't prove it, you win. If I do prove it, I win. Best 3 of 5. I'll put a poll up and everyone can vote who won when we're done.

You don't have enough admissable proof to back up the criminal part. You have posts from a message board, which are not easily connectable to a specific physical individual. There is no precedent of which I am aware of message board content being deemed admissable to a criminal proceeding.

You would do a lot better with something official, like a press release, an act of commerce, or something that is not a mere internet discussion post.

Looks admissable, but given that it is probably after he rescinded the trademark application, the content may or may not be damning in the manner you'd like it to be. That would be up to a judge to determine, and in a case where no provable damage was done, no charges could be filed for that hearing to happen.

I'm not sure such negotiations (cutting down the tallest tree with a herring in liu of a shrubbery) are allowed in this forum. Under Patsy v. King Arthur it was found that in matters pertaining to the Knights who say "Ni" and "ichy ichy patang ni wong" you can not trademark to prevent future trademark in much the same way that European Swallows can do not have the proper weight to speed ratio to carry a coconut and African Swallows are non-migratory.

Good idea. I moved the pic back to the top, but rather than clutter that area with all of the quotes, I just chose my favorite Foleyism and added it to the top of the page. I left the other quotes where they were.

Foley posted on the other thread that he OWNED the trademarks, but he will just say that again if contacted, whether or not it's legit.

The website I posted is just some dude's weblog saying the machine arrived at his work, and listing the games it has, but it lists Ultracade as the trademark owner, after universal. I don't think the dude with the weblog would KNOW either but I'm assuming he got that information off the ultracade site or the documentation that shipped with the machine.

Basically I was posting it to say that Ultracade is claiming the trademarks more places than just some posts here and at VPF.

I realize it may be cumbersome, but in order for it to carry more weight and/or highlight the humor/irony/scumminess of the situation, it needs to be changed to:

David R. Foley, CEO of Ultracade and self-described public relations liason for Ultracade

Clean it up to be more "official" sounding, but that clearly has to be added to his title, since it's his declaration of his "public-relations" moniker further demonstrates the absurdity of his actions in light of his methods of dealing with his "audience/target market".

I would think "accusations" would fit what you are looking for.

CT's point is well-taken, though, the suit doesn't have to be legitimate to be filed, and would need to be defended regardless. . .
