I have a legal question I purchased a Sharp LC-37D62 -37" sharp 1080P on 02/06/08.  No where on tristatecamera.com, does the website state they are selling refrub TV's.  I spent $1,188.00 on this TV & the Tv went out today.  I emailed the vendor today(they are closed) & will call them tommorrow.  After speaking to sharp on the phone,  sharp informed me this TV is a refurb the tv comes with a 30 day warranty so now I am screwed.  I am in the process of filing a chargeback.  Is it againest the law to not disclose that the Tv is not a new unit I would like to file a complaint with the attorney general if possible.
I carry both ultimarc & happ items, all brand new & I ship from the united states. My online store is ARCADEEMULATOR.NET, pm if I can help in anyway.

Its too late now, but I thought it was always very unwise to purchase anything over $200 online.  Especially large items like TVs.  Where recourse can be difficult.

I only hope you paid for it on your credit card or have a warranty.

They (the seller) could say the item was damaged in transit, and replace it if you are lucky.

Don't hold your breath though.

Legal wise it will be expensive.  You should read their fine print.

Next time buy it local.   ::)

When the TV shows up at your door, refuse delivery.  If you have a tracking number you may even be able to call the delivery company and cancel before it even gets there.  You won't have to pay return shipping if you never accept the delivery.

If you can't get a full refund by talking to Tristate, you'll get one from your credit card company.

Yes.  It is illegal.  You've already started the chargeback process, but notifying the AG is a good idea too.  At least you can be happy knowing that the company will have to eat the shipping charges.

How does he do that when he didn't know it had an issue?  He found out it was a refurb by using it, it failed, he called the manufacturer, who then told him it was a refurb.

. . . the Tv went out today . . . . After speaking to sharp on the phone,  sharp informed me this TV is a refurb . . .

I don't think that he used the TV, or that it has been delivered yet.

Sounds to me as if he purchased a TV back in Feb,  and that it died on him...

yes, the tv died this week, I am filing chargeback & will ship back as soon as the cc company tells me to ship, in the meantime tristate emailed me that they only sell new tv's & please email the serial number so they can investigate.  The chargeback is going forward.

Ah . . . I see.  When he said he ordered the TV and it went out today, I thought he meant that the shipper shipped it and it was en route.

How is it that the company can still legally operate with all those complaints?

Well you got lucky.

Do yourself a favour and help out your local economy too.  Buy local.
