No-one could stand by and watch their ideas and plans, which are your intellectual property, and a saleable product, be bandied around for free.

...I think what DOES matter, is how comfortable consumers are doing business with a DOT COM company.  Because, whether they know it or not...anytime they order something online...they are in EXACTLY the same situation as what has transpired with SlikStik....you just don't hear about it all that often. 

The term "Buyer Beware" has probably been heard by almost everyone in this forum...but never had to deal with it personally.  That's why I feel it is important in running an online company, that customer support and service come first.

I'm glad someone found that link...proves what I was trying to say earlier...people NEED something to complain about, even way back then.

FWIW - as I remember there was a bit more of a wrinkle to it than that.

Something like the plans used to be free or used to have no copyright restrictions on them and then Scott (Cyberpunk) decided to sell them on his site, but the question was whether the original plans that were obtained for free and did not have the copyright on them could be freely distributed.

The answer came down to a legality that copyrights can be applied retroactively unlike trademarks and patents (I am not a lawyer), so since they were Scott's (Cyberpunk's) IP, he could specify how they could be distributed.

But as Scott said, IMHO, the BYOAC members interpretation at the time was incorrect, Saint handled the issue properly, and it is (and should remain) water under the bridge now.

Actually in legal terms that's not the case at all. If you release something into the public domain, you can't then later (retrospectively) take it back as your own copyright property. 

However...... The technicality may lie with the fact that although Scott distributed them freely, that does not necessarily make them public domain, and as the designer of them he does have the right to determine how they are distributed, unless he specifically released them to public domain.

This was the cause of the confusion between "Freeware", which is free to download but on which the owner reserves his rights (as in these plans) and "Public Domain" which is also free to download but on which the designer does not reserve rights and you can do as you wish with (which did not apply to these plans).

If something is public domain, then you can edit it or alter it or even re-sell it if you want to. If something is Freeware then mostly your rights are restricted to your own personal use and you may not re-distribute it (usually the restrictions applied by the original designer are legally valid).

Hope that clarifies the issue......

So Tiger-heli.... No, you can't retrospectively apply copyright... A designers copyright is automatic from the time he creates the design. If he then releases it to "Public Domain" he can't later claim any copyright over it. But if he releases it as "Freeware" He can reserve whatever rights within the law he sees fit to reserve.

Just as I thought it necessary to offer an explanation regarding the lawsuit issues...Here I am in a thread about SlikStik...now offering an explanation as to why Barcrest, uh freebox...is bringing up the past.  Talk about off-topic...

Yes, my company also sells software...one title is Virtual Music Jukebox.  Freebox (formerly know as barcrest), offered similiar software, but didn't charge for it.  Anytime a user would post anything (good or bad) about our software...he was all over that post promoting his.  That is his right, but doing your own search...it wouldn't be hard to figure out just how he provoked me into a mudslinging fight...

Actually, keep this in mind...I NEVER ONCE slammed anyone's product or software....EVER.  Just see how many times this guy does just that.

...I've since learned to keep my thoughts and words (and typing fingers) under control....that doesn't mean I don't WANT to say certain things anymore...I just matured a little since then (I grew up).

...I also know that this particular post is going to relive everything and I'M SURE, we are going to see MANY quotes from posts over 3 years old....I've got nothing better to do today.  So let's see where this goes.

Umm...  I do care about mud, mameroom, some barcrest something and all that, but can we start a new thread for it?  I'm keep going to this thread to see if Xtian's new company has been outed yet and I keep seeing stuff about a Jukebox mameroom software company that sued Saint and then praised him...  Kinda off topic.  So although I do want to find out about all that stuff, can we keep this thread about Xtian and SS and the new company?

Here, I'll help keep it alive also.

IKEA. Ikea would do a good job of making/selling arcade flat packs. All they'd need is a small display of 1 x jukebox, 1 x bartop, 1 x fullsize cab. My guess is they'd be *significantly* cheaper than other flat pack makers. Know any?

Of course I don't know anyone in Ikea management. And, even if I did, being Scandinavian...they'd probably just sit around and laugh in their demeaning Scandinavian accents "ew look this lob idiot thinks we can sell flat packs of arcade machines at a profit...this moron has no idea. hehe." Well f*&^ you Ikea. I fuc**ng hate your stupid store and your crap furniture anyways. Yeah fu*% off back to Europe and leave the rest of the world alone...

I'm glad you now agree that profit margins apply to ALL businesses, which must be incorporated (along with overhead cost allocations) into the retail price.

Pofit margins only apply to WalMart ... LOL    :laugh2:
That's not what I meant doofus. The margins DIFFER because Walmart has to cover the costs of running stores, distribution, marketing, advertising, employees, etc, etc while SlikStik only needs to cover himself and his home-based operation.  So the margin required can be drastically different (ie: smaller for Slikstik)

That's not what I meant doofus. The margins DIFFER because Walmart has to cover the costs of running stores, distribution, marketing, advertising, employees, etc, etc while SlikStik only needs to cover himself and his home-based operation.  So the margin required can be drastically different (ie: smaller for Slikstik)


You could also say because Walmart deals in such ridiculous volume, and SlikStik deals in double digits, Walmart's margins can be microscopic in comparison and they'll still make money.

Thanks for demonstrating that this is a fairly straightforward line of reasoning.    :)

But it's of no use ... I've already spelled that out to RayB, and he doesn't want to listen (or politely agree to disagree) ... he'd rather just ignore that reasoning, and hurl his personal attacks :


Niche businesses need to include a larger margin in their pricing.  WalMart can afford to have a very slim margin indeed (on a "per unit sold" basis), because they can recoup their overhead costs (and make a profit) over millions of units of product sold.


Not that I know why RayB's still dragging it up ... that discussion took place almost two weeks ago ... yesterday's news.

About the only thing left of any interest in this thread, is FrizzleFried's question of whether it'll get a sticky.

I dunno about that.  I'd like to see updates from the people who got robbed saying that they either got their money back, got their product, or had a successful lawsuit.
