its an optional addon that games will not play off of.  all 360 games will be dvd

Can't Microsoft push patches onto your machine that negate the DVD firmware upgrades? And even if they don't do it yet, isn't it theoretically possible? I thought that was suppossed to be one of the downsides to that method.

(Not trying to bust your biz. Just think it's something people should be aware of if it's true.)

they cant "make your system stop working". worse case scenerario you can get banned from xbox live. but to this date you can still play on xbox live no problem. latest samsung drive FW has "firmguard" which locks the firmware and you cant really patch it.

theres always the option to stay OFF of xbox live, simply dont plug in the network cable.  the samsung firmware also is locked as of 4.0 which means microsoft cannot alter, flash or even detect the firmware (supposely)

I never meant to imply that they would shut your machine down. I meant to say that I heard they can potentially negate the effects of the firmware upgrade with a patch. And of course they can always cancel your XBox Live access.

Snaake's offering a good deal if anybody's looking for a modded XBOX 360.  It would cost you $399 plus tax plus shipping the drive to someone and paying them to flash it if you bought a system new and wanted to do this.

As far as I know this is not an illegal sale - Microsoft may not like Xbox modding, but I have not seen that it is illegal. Pirating games is of course illegal and is not welcome here. Modding or modded hardware is fine.

Is it possible for you to just drop it?  Who died and elected you grand chancellor of what is right and wrong when it comes to consoles?  The new policy clearly states that IF it is shown that modding consoles are illegal in the USA, that this discussion would be curtailed.

Whew!

It took me a total of 15 minutes to find the information I was looking for.  The internet is great, but navigation needs looking into.  I mean search engines and google is great, but it puts a new meaning to going around in circles.

I found the section you guys need reading.  Its a scary section, and needs rethinking, that if you indeed do these types of things, you might want to do it quietly and to yourself.

Chapter 12 says it all.  I wish I took the time to research the subject before going in guns firing and all that.  I am not a person who likes to point certain facts like this out, but I am a person who is sick and tired of individuals breaking the law and saying it is ok to do it.

I'll cut it down to these three paragraphs:

§ 1201. Circumvention of copyright protection systems2
(a) Violations Regarding Circumvention of Technological Measures. - (1)(A) No person shall circumvent a technological measure that effectively controls access to a work protected under this title.

(A) to "circumvent a technological measure" means to descramble a scrambled work, to decrypt an encrypted work, or otherwise to avoid, bypass, remove, deactivate, or impair a technological measure, without the authority of the copyright owner; and

(B) a technological measure "effectively controls access to a work" if the measure, in the ordinary course of its operation, requires the application of information, or a process or a treatment, with the authority of the copyright owner, to gain access to the work


There is more, including the section about changes to the law regarding obsolete systems.  Other words, emulators.

Once you open the plastic box and insert the chip you are breaking the law, unless you got permission first..  Selling an item under this statement.... well I 'll leave that up to you.  You are all intelligent individuals here, and it should take 2 seconds to figure out.  I'll go a bit further and ask you if you got permission from Microsoft to mod your chip.  If so, then you are legal.

I love homebrew, also like the idea, and also the economic mechanics behind it.  It sells the console, but there is a risk attached to it a risk I would not like to be put before a court, before my family, my employer or ISP.

I'm sure you think I'm a real jerk for pointing this out, spoiling your fun, telling you how to run your business or life, well I'm really sorry about that.

Really truly sorry.

But if I can make a small difference to a world going bad, is it such a crime?

Let's all of us make a new year resolution:  Say no to modding consoles.    :angel:


*Edit:* There is a provision to the law that says the limitations of the law diminishes after 5 years of the date of the offense.  So if you did mod your xbox in Dec 2001, you won't go to jail for 10 years or pay a $500,000.00 fine.  Hope you keep your receipts.     ;)

as I see it adding a modchip to a console is no different to modifying anything else,

if I take a video recorder sold in this country (UK Pal standard) and modify the circuit (with a couple of chips) to enable me to play an american NTSC video.

now think about it, the hardware to play ntsc video's on a pal TV was not readily available (until about 2 years ago), as long as the video I am watching is not a pirate copy I am doing nothing illegal, I am not attempting to bypass copyright, In buying the original cassette I have supported the artists / studios.

the only people that may not be happy about what I have done is the manufacturer of my video recorder as they never intended it to be able to play these tapes (so there goes my warranty)

modchips have uses other than bypassing copyright protection systems, but I have used them in the past to enable a friends ps2 to play backup disks (note the word backup) he owned all of the original disks but his son had a habit of losing his temper and smashing disks, once I fitted his chip he kept all of his originals well out of the way of his son and only gave his son the copies. when the copy became damaged it was replaced with a fresh copy from his original (rather than having to go and buy the game that he already owned again).

regardless of what some people think This is NOT the place to be discussing this, Saint (the owner of this site) has already said that he has no problems with the items for sale and as far as I am concerned that is the final word on this matter in this thread.
I would suggest that people wanting to discuss this further take it to the consoles forum rather than here.

The law I was quoting was for everything copyrighted.  The scary thing is, what about copyrights we use for avatars, websites, arcade artwork?

I remember a new article way back when the internet was still being viewed by Mosaic and Windows 3.1, and this topic came up.  I think copyright works will be more enforced as software gets clever.  Software isn't clever yet.  Microsoft is working on authentication, and the DMCA might look at similar steps if it got someone powerful behind it to make the stand.  I'm sure there won't be enough jails or lawyers available to deal with the casework or monies involved.  Maybe they sue you via paypal?

Coming back to my comment above, which I hope it wasn't sarcastic or offensive, if you feel that way - then I apologise. 

You mod a Ntsc video recorder to make it play PAL tapes.  I don't think there is any protection in the VCR to make this a point.  Except snowy screens and sound like the chipmunks.  If you had a Panasonic VCR - you could possibly change the voltage and the electronics to play back in PAL.  I have never heard this done - we just bought a TV to play the tapes on the VCR.  I'm US/UK citizen so this scenario applies to me too  I have collections in both format, especially laserdisc.  Now its moot as my UK VCR plays back my Ntsc tapes just fine.  Would be cheaper to buy the tape in the UK unless it was "I Spit on your Grave" which was banned in the UK until just recently.  Its on UMD now would you believe it?

"Mod chips has uses other than bypassing protection systems" - yes I agree with you, but your idea would not hold up in court, as you would have to buy another disc or ask the manufacturer to replace it via a small charge, because your child smashed it.  To think otherwise would be funny to any copyright lawyer.  Go ask one.

Because I agree with you doesn't make it right.  To mod an xbox takes some planning and equipment, and you cannot play backups with an un-modded xbox? - I wonder why?  Guess you will be extra special with that 2nd purchased disc.

Good idea with the above poster on making this a seperate topic.  Can a moderator put this in EE with the original Xbox 360 post too?  We have to give it reference, now since it is acceptable behaviour according to Saint.

Lloydcom, some people are intelligent enough to disagree without being disagreeable.  You don't seem to be one of these people.  I won't even try to reason with you because you are an unreasonable person.  You have failed to see anything except what you want to see, and of course have chosen only to find information which supports your limited and misguided view.

There's no point in asking the opinion of a copyright lawyer. Most of them are hired by large corporations to protect the interests of said corporations. That's how they earn their living so they're hardly impartial.

Even if your extreme interpretation of the DMCA is correct (and I don't believe it is), the fact remains that it's still very bad law. It goes way beyond simply protecting intellectual property rights and attempts to curtail well established ownership rights. The act is definitely open to legal challenge as M$ found out to its cost.

I would like to make a motion that lloydcom be banned from this website.  Saint tried being nice to him and lloydcom is now taking shots at Saint. 

Lloydcom, some people are intelligent enough to disagree without being disagreeable.  You don't seem to be one of these people.  I won't even try to reason with you because you are an unreasonable person.  You have failed to see anything except what you want to see, and of course have chosen only to find information which supports your limited and misguided view.

Oh and are we calling xbox mods the same as terrorism?  We are if you are silenced for the right of free speech, and showing your point in legal fact.  If I remember Saint's post that he didn't know that it was illegal to mod a xbox, and I showed him publicly, so to change his rules of the board and protect him against any threat to his site.

If that is the case - then you have no other reason other to ban me.

Edit: *Yes I changed the correct title to my reference - apologies for the oversight.  I cannot vouch for those who work in the software business, but I would like Saint and any moderator to prove that my legal fact is wrong. 

And yes I do not live in the US, but the UK has laws that already ban modding, so that point is moot. Austrailia laws will change with the FTA.  I've looked on tons of xbox fourms and their mods don't allow sales of modded xbox 360s or any such talk.  The King comment is a bit extreme,  and my sincere apologies for using it out of context but he was silenced for his views, just like you posters are promoting a ban to silence my views as my comments are not politically correct. 

Besides who like a trouble maker or a person rocking the boat.

Where does this get me? 

Hopefully someone will take responsibility, because if someone gets caught selling something illegal off this site - I would be very sorry to see Saint get into any trouble.  But reading the other poster's views,  on the subject, makes me think you don't care.
