Hey guys - I'm fairly new to ebay auctions. I haven't bought that many things. I bid on an item and won it. It is an item that sells new for $350ish and I won it for $41 and $35 shipping for a total of $76. I sent him the money via paypal. He hasn't accepted it - it's sitting as a pending transaction at my bank. I won the item monday morning around 9am.

He hasn't responded to my emails
He re-listed the item again with a buy-it-now price of $179.99

It seems obvious that he isn't going to let it go for the price I won it for. My question is what can I do? Am I reacting too early? (2 days and no word). If I am not going to get it, I want to bid on other items. I still need the item I was bidding on. I don't want to win another bid and then he gets in touch with me finally and then I'm stuck buying 2 of something I only wanted 1 of.

Any info would be appreciated. As I said, I'm fairly new to purchasing ebay auction items.

Start off by reporting him to Ebay. Even if he doesn't send you the item, at least try and get your money back. I believe you can also do the same directly through PayPal. You can always leave him negative feedback, so other buyers know what he is up to. To be safe, I would personally try and get my money back first.

Definitely go through ebay 1st. I am sure you would want your money back but probably would rather have the stuff. Also send a message to the seller through the new listing, and any other email that you may have. Try not to make accusations that they are ripping you off, even though we all know that is what they are trying to do. Make it sound like you think they may have made a mistake by not sending you the item, and then relisted it. Make mention that they should have put a reserve on it if they did not want it to go for less than a certain price. 

If they do not respond,  then start to threaten negative feedback, etc...

Yeah, I think it's pretty obvious what his intentions are.  Could you give us a link to what it is?  Might be a dishonest seller, if he's pulling that.

Since he hasn't accepted the paypal yet, get it back asap.  He's obviously been online to relist the item, so he should've seen his emails by now.(though he may have multiples, but I doubt it, from the sounds of the situation.)

Leaving negative feedback.  That'll only get you a negative in return, through no fault of your own.  That's what sucks about it.  eBay rarely does anything about it either, no matter how much you are in the right.  I've received one ill-gotten negative feedback.  I sold a game-n-watch handheld game.  Listed it as great condition, and that it runs, with new batteries.  That's pretty much all I said.  After the guy received it, he left me negative feedback, saying I "made false claims" about what it had.  No serial number and whatnot.  I never made claims it did in the first place.  I complained to ebay, asking them to remove it, (the guy ended up cancelling his ebay account) but never heard anything back.  So if you leave a negative on his, expect one on your own, and since you're new to it, it can be detrimental to how other sellers respond to any of your bids in the future.  Unfortunately, that's how ebay rolls with it. :P  Freakin' buttwipes.

I would go to Ebay first as i think what he is doing is against their policies.  Let them know the orginial item number and the re-listed one as well.  As for getting your money back, if he has not picked up the money, then you have not lost it yet.  I would contact PAYPAL also starting a claim there too.  What is most likely going to happen is the guy will "refund" your money and re list the item anyway.  Sorry but it is the  nature of the beast.  To be very honest, ebay protects its seller WAY more then it protects the buyers.

Take it up with ebay first. If that fails, PayPal will most likely get you your money back. PayPal will almost always refund your money.

Shouldn't he be able to cancel it himself?

Either way, all he has to do is contact the seller and say "deny the payment I sent!". Then leave it at that. It's obvious the guy wanted more than the auction ended for.

I just had a run in with ebay and paypal too! I bought the item Buy it Now and paid right away. The guy didn't email me for a week, then he said he would send it next day and give me tracking info. He never did, 4 emails not responded to and 3 weeks later I filed with Paypal. He finally sent the item but left out the remote! I am really irritated now! Paypal closed the dispute because he finally sent the item, now I will have to go through it all over again to get the remote! He will not answer my emails! Can't use the player without the remote and the auction clearlt states the remote is included and even showed a picture! I have never had a problem before now. But Paypal did help me get the item! Good luck. Maybe you should let us know who the seller is and what the item is so we can be aware.

I have sold things on ebay and you sell for what your price ends at. I learned that if you want more money for something you put a minimum bid or a reserve, he should know better unless he is new to ebay.

PayPal is NOT secure.  I'm not going to go off on a PayPal rant, but suffice it to say that you are not "safe" as a buyer or a seller with PayPal.  Paypal has very lenient "rules" that you have to follow.

If you, as a seller, can prove you sent SOMETHING, you're off the hook and PayPal doesn't care anymore.  I can send you a picture of the item, but if I have tracking info, PayPal doesn't care.  You'll have to take it up with the authorities.

Don't kid yourself.  Paypal really isn't that safe.. its just a necessary evil in online buying/selling.

He's in Wisconsin.  You won the item and, therefore, have access to his home address, phone# etc.   Go to his house with the money in hand and demand your monitor.   If he refuses, return with a bat :)

My brother was screwed not long ago, as a seller. The item got damaged in transit (USPS acknowledged that they damaged it). The guy filed with PayPal, saying that the item was "not as described". He got his money back, no questions asked. There was absolutely nothing that could be done about it (PayPal even admitted that it was messed up, but that it was their policy). All my brother was left with was an item so damaged it was useless and the minimum insurance money of $100, because the guy opted not to insure it (the item was quite a bit over $100).

That is why I say you are in a good position as the buyer, but not as the seller.

Your brother made the mistake of keeping the money in his paypal account.  If his account was empty, it wouldn't have happened, and effectively.. he could have "screwed" the guy if he wanted to.  The worst that would happen is his Paypal account would be frozen, but if someone were to do this in a short time frame for a lot of money, the person wouldn't care.

Again.. PayPal is not safe.

It really screwed him bad since he had to ship the items but all the money went towards PayPal. That's why I said you'll get your money back, but it may take a while (depending on how active he is).

Have you considered that because the money is unclaimed that maybe the chump lised the wrong paypal acct in his auction? Pursue with ebay and try contacting the seller. If he doesn't reply request his phone # and call them... if you want the item.

He responded today with a tracking number. Something is coming from his address.

So, I think it all worked out. Maybe I jumped the gun, but I appreciate what everyone said. I'll keep it in mind for future auctions.

Well just cancel the transaction if the money was not accepted.  You may have sent to a wrong address.

He may of not had money in the account at the time the buyer's claim was approved but because your brother continued to do bussiness on that paypal account he was haveing money deposited into it.  PayPal will continue to withdraw any money from the account as soon as it is deposited until the claim is fully paid.  But if your brother had just cancled his paypal account and then made a new account the buy would never have recieved any money which is what happens allot of times.

My beef with Paypal is that once a transaction is in process they have no control over it.  I Purchased an ebay item a month ago and my bank for some reason rejected the money transfer to paypal.  It is Paypal's policy to try two times in the span of 2 or 3 days so even though I knew the transfer would be rejected again they could do nothing to stop it because it was in process.  (Paypal's words)  Before the second attempt I realized my backup funding source was a credit card that I did not want to charge anything to.  Okay, no problem.. Since paypal was still focused on trying to get money from my bank account that I knew would be rejected I will just change my backup to a different card.  Sorry!  Your backup funding source cannot be changed while a transaction is in process.  I was a bit irritated by that point so I call Paypal and the first person I talked to could barely speak english so I had a tough time explaining the problem so she would understand.  I finally got a supervisor on the phone and he told me the same thing.  Even though I had a different credit card in hand that I could charge to he could do absolutely nothing to change the transaction funding source.  I'll tell ya, Paypal is extremely convenient but they need to become a little bit more user friendly.  In response to the situation where the product was damaged and the buyer claimed the item was not as described, if the buyer didn't insure the item then he should have been the one to eat the cost and keep the damaged item.  Its a crock that paypal would refund someone's money without seeing the "big picture".  Okay, now that I am done ranting I feel surprisingly better.   :D

Hey, Sellers can get screwed by buyer too. If you ship something out via a method that does not have tracking, you can't prove you sent it. PayPal doesn't give you the option of sending in scans of receipts. They ask for a tracking #. If you don't have one, they will side with the buyer. Happened to me.

Here's what you do:

Drag his @ss by the car bumper down the road til his skin falls off, then pour alcohol on him. Then light him on fire to a nice toasty flame, Once he falls to the floor, then grab your stick and put a marshmallow on the end of it, also dont forget to bring a hot dog or 2.....   :applaud:

Whenever I buy something off eBay I always use my CCARD through paypal instead of my bank account.  The reasoning is simple, your CCARD company will always side with you (as long as you are in good standing it makes it easier).  If I have a problem with a seller, which I did about 1 month ago over some saw blades, I will contact my CCARD and tell them I need to do a chargeback.  They will temporarily return the funds and all you do is send the documentation (emails and paypal transaction) to the address they provide.  Once I received the CCARD refund and a Paypal refund for the same item, wasnt that much $$ but was a nice little mistake.  I recommend always pay through paypal with your CCARD as your funding option and do not erase any email until your are satisfied with the transaction.
