There blatently not legal. I dont see anyway how they can be.

The artwork was designed by Peale who uploaded it to the Arcade Art Library (http://localarcade.com/arcade_art/).

I know Peale doesnt mind people using the graphics on your own cab (I loved it so much I desgined my whole colour scheme round it for my cab). I should imagine he would'nt appriciate it being used for commercial gain, unless they have his permission of course.

That's probably the case.  ROM's original pic was just the exploding backgroudn with no text.  I only remember because I followed the thread closesly and LOVE the pic heh.

 Single player console designed using a TOKN KB16 Encoder. Features: 4/8 way joystick, 6 action buttons, coin button, 1 & 2 player buttons, & the 2 side buttons for escape and select game. Fully fuctional from MAME menu thru game play. Easy button reprogram options. Hot swappable ps/2 connection. Heavy duty 1/2" construction!
Why a TOKN? Sound kinda odd to me. I've heard that business that dont do well will open a new business to make up. Besides, this guy has no right to use that artwork! (a=He is using someone else design, b=pacman etc. are trademarked, im sure he didnt get permission to use them!)
