Mala layout gamelist as Marquee's now No Volume text

I have made my layout in the mala layout editor,
gamelist as Marquee's is working great but when i want to change my volume up or down i get the black window with No Volume text.
if i go into my layout.mll
    imagelist=1
    imagelistpath=1
    BUT if i change them back to =0
    i have no marquee list - its all txt and my volume txt works.
    can i have both a marquee list and have my volume work too.

    Any help would be great, its driving me nuts

No idea about the volume, but shouldn't
imagelistpath have the path to the marquee images, not a 1?

OMG RESOLVED :(

the BGcolor was set to Black and So was the text.
