If you are deemed to be "intoxicated" in a bar by an undercover Texas cop, you best be prepared to go to jail. Why? Because you MIGHT be a danger to yourself or others. You MIGHT make a bad decision and walk down an alley that, if sober, you wouldn't choose to walk down (this is actually the argument put forth by the TABC representative on Tucker Carlson's show tonight). THEREFORE, we're going to arrest you.
There's no BAC level that needs to be broken. You don't have to be a .08 or .1 or .2 or .whatever. If these undercover cops decide that you are intoxicated at a bar, you've broken the "public intoxication" law and you're screwed.
And "intoxicated" means "not having the normal use of mental or physical faculties". By that definition, the moment you feel
any affect of alcohol, you could be deemed "intoxicated" and be arrested.
