No, the major reason for the arrest is he was selling them in quantity..
had be just had his own xbox , and had 80 game on there, their would have been no harm and no foul..
he was profiting by selling them for 300.00$ apiece. that was his mistake..

the curious legal twist about this case is that the EU banned Modchips, not mods.. so how,or could this case have been prosecuted with a softmod//

I'm sure he could have been convicted with a softmod because of the 80 games, as Dynagod said.  It is illegal for him to make copies of retail games for resale, which is what he was doing by copying the games to the hard drive..

By the way, if anybody wants an Xbox modded I'll do it for you and preload 60 games onto the hard drive.
