Take that Record Industry!
« on: May 19, 2005, 02:59:46 pm »
I was looking to download a new song by the "Kaiser Chiefs - I Predict a Riot".  So I started looking for the song on KazaaLite.

I guess what the Record Industry has done is put fake songs on Kazaa.  They look like normal songs, but when you download them and try to play the song, it's a 17min+ song that's blank.

That practice doesn't bother me as I can usually find the song I'm looking for.  But for some reason, I couldn't find a good version of this song.  So... I went elsewhere and downloaded the whole album in 15 mins for free  ;D

It's not the record industry, people have been doing that since the early days of Napster.  They would hide other files they were distributing as filenames with popular artists.  I can't tell you how many times I'd download a song by Eminem only to find it was some guy ranting for 4 minutes about how much of a ---stingray--- his gf is... or to find it's really a zip full of images you do not want.

Okay....No really, I believe you.

Anyway, there is a great russian site that has most of what you want for 2 cents a megabite.  I no longer spend any time looking in spyware circles.

It's www.allofmp3.com

For the time being, at least, it's legal.

Yeah, it's awsome.  There are some annoyances and a limited selection.  But if you just want the new pop music, it's the best.

To be honest, I'm a little concerned about giving up my credit card info to a company that's overseas.  How did you pay when you signed up?

I paid with the paypal type service that they use.  I wasn't comfortable with it either so I used an old account I could afford to lose in a way.  It was some time ago that I  did it and nothing has happened, but it's a bit of a buyer beware situation.

It's legal because its a russian site(or somewhere close).  It has already be shut down once by the ipfi. But the Russian courts found the company was not breaking any russian laws and it opened back up.  Here's an article that mentions allofmp3 about half way down.

It's legal but "technically" shouldn't be available to people outside Russia. But that's not our problem. :-)

Actually, that technically IS our problem.
While they aren't breaking russian law by providing their service, we ARE breaking US law by using it.

They have this disclaimer
"Users are responsible for any usage and distribution of all materials received from AllOFMP3.com. This responsibility depends on the local legislation of each user's country of residence. AllOFMP3.com's Administration does not keep up with the laws of different countries and is not responsible the actions of non-Russian users."

Is this a disclaimer suggesting that downloading from their site could be illegal in my country or is it talking about further usage of the music,ie making cd's, fileshareing or bootlegging?
What US law would I be breaking?

According to their site they pay for their music and have the right under russian license to distribute it across the world.

"All the materials in the MediaServices projects are available for distribution through Internet according to license # LS-3М-05-03 of the Russian Multimedia and Internet Society. Under the license terms, MediaServices pays license fees for all the materials subject to the Law of the Russian Federation "On Copyright and Related Rights". All the materials are available solely for personal use and must not be used for further distribution, resale or broadcasting."

How do I as a consumer know that I am breaking any laws in the U.S.?

Shape, that last link didn't work at all.  I tried Googling it, but I got a bunch of oddball sites of other guy's bands and whatnot, and I even found a link to Metallica's website! ;) ;D
