if you trust me enough, you could send me your harddrive and I could download it for you and send the HD back; or find someone close by wih broadband and take your 360 there =)

Yeah, it would not work for you.
The game would be tied to his 360, and you would only be able to play it on yours if you were logged into Xbox Live, which of course is the whole problem in the first place.
The way 360 DRM works is that it is both tied to the 360 it is purchased on, so that any profile on that 360 can use it, and it is tied to the profile that purchased it, so that profile can go to any other 360 and play it as long as they are connected to Live.
