So I won an auction on ebay for a cherry master game for like $108. I pm the dude and ask him when I can come and get it cause he's like 30 min from me. He says I'm not letting this go for $100 there was a mistake in the auction, because the reserve wasn't posted. So what are my options. Also it's not like it was the first thing that he has sold on here, he's sold a lot of stuff on the bay.

Technically it is a contract. Trying to get eBay to take any action other than sending threatening messages is pretty much useless. Taking proper legal action would cost way more than the actual item in almost all cases.

Negative feedback is probably the best you can do

Did you ask him what the reserve was going to be? Maybe you guys can meet in the middle. So if he wanted $200 and you won it for $100, then goto $150. Explain to him your situation and maybe your guys can work it out.

This is good advice. Not all eBayers are completely honest, especially when they think an auction is going to go much higher than it actually does. Find out what he can live with.

Also, I believe if this seller has done this repeatedly and
broken contract, Ebay can suspend his membership/privileges.
They may not be able to tell you this, but it might make you

He said that the reserve was supposed to be $1000, on his second auction, on the item that I won, and he said that he lowered it to $400, and as soon as he told me that guess what, my new bid of $100 went up to $400 in like a minute. When the first auction was up for like 5 days and never made it past $110 this one jumps up to $400 in the first couple hours?

You pretty much lost out on this one pal. Ebay's dispute system is indirectly designed to only help crooks. You really should have waited to have the cabinet in hand before buying those other things. Sucks for you, but he isn't responsible for that at all. You can try to guilt him, but apparently he is a guiltless bastard anyways.
Still, report him for breach of contract. He might have made an honest error, (doubt it though, he was just trying to save on fee's and got caught.) but if it was an error he had PLENTY of time to catch it before end of auction.

My opinion is if the guy is being a jackoff, then have at it with the complaints to ebay. If he is being sincerely apologetic, just let it go with neutral feedback. I remember when I thought I bought an Ipac4, when I really overpayed for an Ipac2. The seller could have held me to it, but he was cool after I explained to him my mistake. We mutually withdrew from the deal and he got his fee's back to relist.

Sounds like a shill bid to me.

Report his actions in full detail to Ebay and go from there.
A bid is a binding contract..... period.
No reserve, you were the high bidder, done deal.

But in all honesty, aside from reporting them, I'd move on to looking for another machine.

Yeah he's not being apologetic at all and is just like whatever. I'm a wait and see what he says tomorrow and then go from there.

I don't even use ebay because ---That which is odiferous and causeth plants to grow--- like this happens far too often and the system is set up so that only the sellers win. Unless the seller is selling something to some cybercriminal in southeast Asia that's paying using Paypal with a stolen credit card and the seller has to accept credit card payments to be able to use Paypal and then gets his assets frozen because Grandma Edna couldn't keep her damn credit card number out of the hands of a cybercriminal in Phuket.

Do you have a link to the auction? He could have stopped it at any time and re-listed it if he'd seen the mistake (and he should've).

And he was going to have a reserve of $1000 on a Cherry Master? That seems a little optimistic.

Give up and report the guy to eBay. Not only is he not following through with the "legally binding" auction, he's using eBay to sell the exact same item again. I'm not sure on the details, but that has got to be a violation of eBay rules. If nothing else it proves he has no intention of going through with the sale and his new auction should be stopped.

I've sold items on eBay plenty of times and I regularly check my auction. I'm sure I would notice the lack of a reserve price or the starting bid being too low. I'm assuming he's trying to circumvent fees (by gambling and hoping the ending bid would shoot up to where he wanted it or by making you pay him more outside of eBay's system). I recommend writing a full, detailed complaint to eBay (include emails).

I agree that it's saint's site, and thats all well and good, but for the people in the area they need to be aware of him and what he does. It's just like the warnings in the bad traders sellers list. It still pertains to arcade stuff, and that is what this community is about.

Having said that, if this guy were a criminal scammer, I would think differently.

We have a guy, relatively local to me, who is a well-known scammer (search: Mark Uttley) on RGP, CL, KIJIJI, Mr Pinball, CGCC, MAACA and other sites. In that case, where there are CRIMINAL charges involved, then I can agree with the release of personal information for confirmation of identity. NOT because some 18 year old kid on a message board says so (and I believe HD's story, but really, what do we know about each other ?).

Oddlly enough, I was talking to a friend of mine at Saturday's auction ... he matches the general description of the local scammer, drives the same freaking vehicle and lives in the same general area ... yet, he is completely legit and unrelated to the scammer (confirmed, though I tease him otherwise). Sucks to be him right now. (neither here nor there, but interesting consequence of the release of information).

Just let it go. It sucks that you bought the replacement stuff already, but it would have been more pragmatic to wait until you actually had it. Yes, this other guy is 100% in the wrong, but unless you actually want to press legal charges or go to his house and rough him up, you'll just have to report him to ebay and hope they do what needs to be done.

As someone else suggested, it wouldn't be a bad idea to post about him in the bad sellers thread.

I tried to buy a painting around Christmas time and the seller kept bidding against me to drive the price up, and when I stopped bidding, he emailed me and tried to sell it to me at the last price I bid at when the bidding closed and he won his own item. So lame. I of course ignored the offer as the whole thing was just way untrustworthy and crude.
