Bad eBay seller ALERT: ARCADNER
« on: April 04, 2005, 02:12:26 pm »
Bad ebay seller alert!

Don't get burned by this ebay seller ARCADNER as I did.

He has a lot of great stuff up for auction and does a great job in advertising it, but he will screw you if he has the
chance.

Here's a recount of my dealings with him:

I won an auction for a NAOMI POWERSTONE cart on March 4th and paid for the item via Postal Money Order (shipped the Money Order via Priority mail with delivery confirmation). On the 7th I received mail stating I would receive tracking info when it shipped. On the 16th I began inquiring on the tracking number and went through many hoops like being given a tracking number which was for an item that was shipped to him, to being given a second tracking number which was for a different transaction we had (happy with that one), and then was told it's possible it wasn't shipped yet and that he would look through his pile. Over the course of the next 10 days I received no reply to any of my inquiries which stated I just wanted the cart and that I'd still be willing to leave positive feedback if he just worked with me. I finally received the following on the 29th:

"Listen your item was shipped  I don't know if you're just trying to take advantage of the fact that I didn't get a tracking service or if you really didn't get it, I have no control over whether or not the mail carrier makes a mistake or a package gets lost, it's possible it will be returned to sender if there were difficulties in transit, I did exactly what I was suppose to , you paid me and I shipped it the address listed with payment, are you certain the address on payment matched with where you are expecting delivery? I have no reason to try and screw you, I already sent you one item problem free"

I sent a couple of other assuring that I am not a crook. I asked if he could see how I am out $100 bucks and he couldn't assure the package was even sent. This followed with a couple more email which I received no response. In the mean time he put new auctions every couple of days for items that I would normally bid on. With him putting up new auctions I was certain that he was just ignoring my communication attempts and hoping I would simply go away.

Needless to say after a couple more days I opened up a dispute claim with eBay which sort of forced him to acknowledge me. His first note in the dispute states that the item shipped on the 7th. This is the same day I was informed via email that I would be notified when it shipped. (yep no notification as stated before).

I sent a couple of more emails and received the following:

"put in the claim with ebay and if you get the coverage money I think it is less than the amount paid like 75 for 100 USD, I'll pay you the difference back and let you know if a package is returned to me

Surprise because of the use of a Money Order eBay will not cover it under Buyer Assurance. I have been unable to get response back from ARCADNER since the 29th.

So I felt it my duty to warn anyone else that doing business with this guy is not a good idea.

I still have one course of action: I've spoken with the POST OFFICE and with law enforcement in his area (MANSFIELD, MA) and apparently it constitutes "Mail Fraud" since the transaction was primarily by MAIL on POSTAL MONEY ORDER (Payment) and sent USPS PRIORITY MAIL.

Again, I'm not a malicious person. I merely don't want to shorted $100 and ignored when trying to get expectations. The thing that chaps me though is the attitude of "I have no control over whether or not the mail carrier makes a mistake or a package gets lost" - This is why there is Delivery confirmation which is what I was told to expect at the beginning of the transaction. This is what all good sellers do as a matter of CYA for both parties.

Sorry if I began to ramble, but please be careful.

I will definitely not be buying anything from this seller. I hope you get your Naomi cart our 100% refund for your purchase. I know i have never had anything lost in transit with USPS priority our first class packages so i have been pretty fortunate but this guy has 2 strikes already since he cant even get the shipping status correct and a total lack of communication.

Have an item outstanding with him currently ... we're having a minor issue right now (apparently he was charged US$20 for cashing my Canadian MO), but hopefully will turn out.

Good luck ... hope you receive your cart, Goz.

Cheers.

Simple enough.... In my case I simply picked up the phone and called (got the phone number via Internet white pages). They may transfer you to a detective who will help you file a complaint over the phone. Another option is to contact ic3.gov (internet crime complaint center). I'm letting eBay try one last time, they requested I wait 10 days while they contact the seller, if still no response, etc they will lock his acct and he is a very active seller so that'll hurt him. I still have the Postal Money Order reciept which leaves a venue for complaint through USPS which will prosecute for fraud.

Good way to prevent getting screwed is to pay with Paypal using a credit card.

It would seem every Ebay rip-off story I hear about involves one common thing: Money Orders.

US Postal M.O.  help.
I am lucky I guess.

I have allways got what I paid for. I have bought 1 joystick with all leafs busted but a quick email and the seller sent me 4 new ones.
good luck and thanks for the heads up. I will stay clear of the jerk.

I have had the postmaster involved in other maters before. They seem to take there jobs VERY seriously.

I have to agree with a few of the posts above.  I no longer bid on anything unless I can pay with PayPal or a CC.   I have been screwed a couple of times (fortunately for not a lot of $$$) and each time it has been with a money order.

These days, if they state they don't take PayPal, I don't bid.

Sorry you're getting hosed, I hope you get it resolved successfully.

You can cancel a money order though and you can also track whether or not it has been negotiated.  My mom works at a bank and I just sent a M.O. to "Vicious".  If I keep the receipt, I can check whether or not he has cashed it.

I rarely do business with people via Money Order its just too damn dangerous. Anyways I took a chance and re-afirmed that I need to stick to credit card or paypal for rapid recovery when sphincters like this guy try to pull a fast one.

I have a couple of days left on the eBay claim and then its straight to internet fraud and mail fraud. This turd has had too many chances if it doesn't get resolved by itself or by ebay claim, I am prepared to press charges even if I have to spend $1,000 just to send the message that he can't get away with screwing people. The USPS and Internet Fraud group don't require $ to prosecute, etc... but if i need to I would fly out to press charges with his local law enforcement.

Only time will tell. I'll let you know how it turns out.

I have had stuff lost in the mail before. I got it a few weeks later and it looked as though it had been run over by a steam roller, but I got it.

I wouldn't get too nuts with this guy just yet. I'd give him the benefit of the doubt for now, but it's good that you let him know that the axe is gunna start swinging if he isn't on the up-and-up.

A little of topic but a tip for doing biz on ebay.

If you are selling stuff and using paypal make sure you get a tracking number.  I shipped stuff to a guy and it got lost and he was a total dick about it he must have thought I was ripping him off or something but stoped replying to my emails.  He ended up getting his money back through paypal since I didnt have a tracking # I couldn't prove weather or not it had ever gotten there.

Even with a tracking # paypal will screw the seller over. If the buyer reverses the charge Paypal will not eat the cost (despite their seller protection) they will make you pay (they always find an exception to their own rules).

As an ebay buyer, I will always use Credit Cards thru paypal (now with no checking account linked).

As a seller, I will never except any form of paypal payments (wether wired funds or credit card). You get burned once for $500+ you better make sure its the last time  :police: Paypal even had the nerve to charge me an additional $30!?

Weird - I actually used to know this guy from college.  I bought a few Neo Geo MVS games off him in the past with no troubles whatsoever, but then again, I knew the guy.  It's a shame to see this, especially coming from a guy who totally flipped a few years back about losing $25 to an eBay scammer.

That's how I've been doing it.  But now, I'm getting notifications that I'm reaching my spending limit and I HAVE to add a bank account to continue to spend past my limit.

PayPal used to have a monthly send limit (I think I remember that), then they went to a fixed amount that they upped a couple of times, but haven't done in years.  I'm sitting at 440 and have zero intention of letting them get hold of a bank account either.  Has anyone ever restarted a new account and gotten the balance back to 2000?

I did manage to get the Naomi motherboard I had ordered from ARCADNER.

It arrived today (oddly before a number of items shipped earlier by the same method) after some problems with money orders (his bank didn't like my Internation Postal MO).

Making any progress, Gozur ?

Nope.. no progress.

eBay asked that I give the std 15 days for them to do their biz and then I am on my own. I'm pushing to have his acct suspended and then the post master if eBay's methods arent successful. If that doesn't pan out well. I will contact the detective I spoke with at his local precinct.

Tommy my friend.... That is where you are wrong. I am a man of principal and as such I am not opposed to hoping on a plane and taking a trip. I would spend a $1,000 over a 100 item. I'm sure it wont come to that; but I am in need of a vacation and i've never been there .  ;D

The post office peeps seemed very interested in the complaint. I could check more with the Internet Fraud people first as well.

I'm sure it wont end with the "Nothing can be done" spin.

Like I told you before, he lives 5 minutes from me.  There is no need to fly anywhere.

Apparently I have him on the run. The turd changed his eBay ID to "gozurlies" which I find enormously funny.

Here's where I am in the process of the recovery process. Keep in mind that I'd like the money returned, but it wont break me if I dont. So being a pain in his --I'm attempting to get by the auto-censor and should be beaten after I re-read the rules-- is the next best thing. eBay wouldn't tell me if they closed his ID down or if he changed his ID. I've not heared back from the Internet Fraud people yet on my claim (it can apparently take a long time). The detective I contacted in his home town is unavailable and I am awaiting a callback. Last but not least the post master last i heard was still pursuing him to recover the funds.  ;D

I recently traded for a NAOMI cart to replace the one that the schmuck jipped me on, so at least I can play the game I should have months ago...

It will work itself out, just wanted people to be carefull with the new eBay ID.

the ic3.gov people most likely won't do anything about it anyway. they'll just send you an e-mail saying that they have a large workload and may or may not get to your case. like i said on KLOV ican go there and deliever a personal message from you.

See my only problem with having someone pay him a visit is that I then potentially become a kingpin / mastermind / Mafia sort of bad guy. Don't get me wrong, I'd like to wring his neck; but having others pay him a visit  ;) just doesn't feel right. I tell ya what though... If you do business with him and as a result he refunds me the cash I'll split it with you. As I've stated before it is more a matter of principal than anything else, but $ is always a good thing.

I'd still like to chuck some dog crap at his house.  I've been looking for a reason to build a car mounted trebuchet.

Also DO NOT sell to or buy from ARCADEGAMESRUS on Ebay.

I sold them a set of good pushbuttons and they didnt pay for them for a while. They said they sent payment, about a 2 weeks later, they asked for a Pay pal acount name, and my auctions say Money Order only, No Pay Pal, and then they said they woud send a money order again, and it was at the point where I said ineeded payment within 5 buisness day or Nonpaying bidder mark and Negative feedback would be left promptly.  And in 2 days payment miracusoly showed up.

Goz,

What I have found to be VERY effective is to request a sellers personal information through eBay.  That's right, you can get all their personal information they have on file with eBay.  Of course, eBay sends them your information in trade in hopes that both parties can work it out.  That first phone call to their home asking them to please clear up the matter is a REAL wake up call for sellers that think they can hide namelessly behind the scenes.  Then, every day, just another call asking for status.... a few days of that and I get my money or my item!

Good Luck!

He removes alot of his auctions before they end. Some people are taking a real chance buying stuff from him off of ebay. Even if you call this guy, I don't think it would get you anywhere anyway.

The phone number that I was given by the eBay folks was out of service. eBay doesn't verify the phone number information that us users / buyers / sellers provide.

Update... this bad seller has changed his name yet two more times.

He went to paypalsucks and now is souzamerica (his real name is David Souza).

I'm likely out my money; but you don't have to be. Do not buy from this vermin.

Great job on these alerts - BTW,  I was planning a snipe on a souzarcade item.  But I think I'll keep my money now.
