Seems like a clear scam..... am I correct?  If so, I wish I knew this guy's home address so I could show up at his door after he refuses to ship the Xbox 360's out.

It appears as if this guy has already pre-ordered his system or systems.  He now placed one on Ebay to make a buck and when it comes out, he will ship.

IMHO, I think he is doing this too soon.  I would have waited will a week before launch.  ;)  Thats what I did with my PS2 preorders.

Oh I see .... this guy is not selling an Xbox 360 system but rather some form stating that he has already been guranteed a system when they are available, so for $49.99, the buyer will receive a gurantee of getting an Xbox 360 once they arrive and not have to stand in line to wait for some overprice one at that time.
