That should have been a clue, though I've lucked out to this point on other auctions with such a disclaimer.  Guess I'm too trusting.

I had the same happen with a Dreamcast game I bought off ebay. Now I wont buy a game unless they have an actual photo of the game/cd. The other thing I hate is I see people that has a listing saying "Xbox cheap, no reserve" Your paying for information on how to supposdly get cheap xboxes. You can see in the comment section that people think they are bidding on an actual xbox.

I would definitely report this to eBay.  It goes against their TOS.

The image may be one that eBay themselves provide.  If it's a title in their database, you sometimes have the option (on games) of using a stock image.

I guess you haven't left feedback yet either, seeing as how he has 1 feedback and it's positive.  Post up the negative feedback AND contact eBay.  Maybe your feedback will keep others from getting ripped off.

I would wait until 89 days after the auction is over to file your negative feedback. That way he won't have much of a chance to retaliate against you for the negative. I would also watch his user ID for any future auctions and if he posts any more software I would warn other bidders about what happened with your auction.
