you've got tons of positive feedback 700+ and a couple of negatives. i'd leave a negative asap and write to ebay. at worst, your feedback percent may go down 1 tenth of a percent. they will probably warn him from selling burned copies. it's not legal to do so, so it really doesn't matter if it's in his description. i'd probably stop short of contesting any paypal charges if you paid that way just because of all the bad stuff that paypal does and you don't want a blemish there. that's just my opinion and good luck whatever you do.

I didn't know you wanted a refund. You should negotiate a refund first. Perhaps even make it a point to mention that you haven't let feedback yet...

He says in the auction that the game is in "mint condition". I wouldn't call a burned copy (presumable on a really cheap, no-name CDR as well) anything like mint condition!

I say burn him!  >:(  Or at least call him names...

I agree with those who said report him to ebay. Selling pirated software is illegal and against ebay's rules.
