can cops pull you over in your driveway...?
« on: September 22, 2005, 07:12:36 pm »
yeah the local cops around here are @ssholes... im driving home from picking up my friend and i see a cop pass me at a traffic light, a minute or so from my house, i saw him lookin at my car, of course cause look at my sig...  but i was just sitting there at a light waiting. so anyway i get home and i get out of the car and a cop pulls past my house slow, sees my car and backs up and pulls in my driveway. im already walkin to my house and hes like "go back to your vehicle sir" im like why, he says i ran your plates and your registration is invalid.  im like ummm ok , i really had no idea it was so i go get my papers and it is. and im like oh, i had no idea. so he takes my stuff, gives me a ticket, drives away.

now yeah it was my fault im driving with a bad registration but i never got a notice for it. and secondly i was already on my property, technicly he never saw me driving i just got out of the car. it was a different cop that passed me at the light and he mustve radioed someone cause he was going the other way. but yeah thats just BS... i will call my lawyer tomorrow during buisness hours and see what the deal is

You could have asked him if he saw you driving on the road and had proof you were driving it illegally.  Because if it is parked on your property without registration there is nothing wrong with it unless it is reported stolen.

Actually in a whole lot of places it IS illegal to have a vehicle parked with expired plates where it can be seen from the street.

In some places it is illegal merely to own an unregistered vehicle.

ok, I can see that then.  Here in WI it isn't uncommon to see old vehicles sit out on lawns growing weeds around them.

If it was the same cop that actually saw your car, then he's within the law by ticketing you in your driveway.  If he radio'd another cop to run your plates, the line gets a bit blurrier, but basically it would be your word against his.

If you were just in your driveway, and not driving at all, then no, he couldn't have ticketed you... at least not in NJ.  I don't think it is illegal to have an unregistered vehicle in view in NJ.  I know a few people who have done so with no problems... it just has to be on your property, not the street.

another story....A friend of mine got a ticket cause he forgot to put the little tiny sticker that goes on the corner of your plates. Here in Jersey, they started that and after a couple of years later, they drop it. But he got the ticket in between those years.  :P

What I hate is being held up by two Mustang GT's with full ground skirts on a winding Forest Service road--while I'm driving a Jeep Wrangler FULL of camping gear.

My other favorite was having to pass a Porsche going UP the Rockies, while I was towing a 2000 lb. trailer.

If you're going to BUY it--Please DRIVE it.

Seph... if he saw you driving it, then yes, he can ticket you for driving with a bad registration.  He witnessed the traffic violation.  Fight it and go to court, though, and he probably won't show up.

Also, laws about unregistered vehicles will also vary wildly from munincipality to munincipality. In some places you won't get hassled at all, in others if an officer spots an unregistered vehicle at your house the whole house will get labeled "Unfit for occupancy" and will have to pass a full inspection before you move back in (common tactic to drive out problem people in my area).

When I was much younger I rented the basement at a friend's house, we were working on my truck in the driveway rather late, didn't get it finished that night, so I had to walk to work in the morning. We didn't put the tools away though, we just left them in the driveway because we were going to work on it more when I got home (and the weather was nice, etc).

When I came home the house was marked "unfit for occupancy". The city had been looking for an excuse to drive them out for a while, and the tools left out happened to go against some ordinance.

I would have ignored the cop and walked in the house. What's he going to do then? I have a TransAm, and I get "the look" all the time. Of course, I also have modded the car, and it sounds like it, so that pisses them off.

I once got pulled over just to check the tint on my freaking window. Figures the jerk actually had a meter to check light transmission. I just pulled the film off, went to the police station, got the ticket dismissed, then put some new film on. Can't have a black car without black windows...

Seph, I asked because here in KY we must re-register ($15) every year, birthday month, at which time we pay tax again on the "taxable" value of the car and have to show proof of current insurance at the same time.  Tax is due even on non-running cars!

I don't mind so much the re-registering but I do resent paying a "property tax" each year.  I feel that it is just a repeatable sales tax in disguise.  Our reminder comes in the form of a tax bill postcard!
And cars not registered with valid plates, even when sitting in your driveway, CAN be ticketed at $100 a day until it's junked or registered!

Sounds like you did all you could to make it right, show up at court with proof, leave attitude at home and maybe you'll get lucky and the judge wil dismiss it.

Good Luck!

What, you think your house is "safe"?  What if you were driving like a bat outta hell, cops were chasing you, and they lost sight of you seconds before turning into your driveway?  No ticket because you weren't tagged out before reaching home?

TheNasty, are we gonna have to hear about your 3 a.m. ticket for the rest of your life, or are you gonna take this fight to the Supreme Court, or what?  Just guessing from your continued retelling of this tragedy, but I'd bet some of that "attitude" leaked out when speaking with Officer Squarenuts, causing ANY chance of "just wanted to give you a warning" to leak right down the drain.

I got MANY tickets due to my breaking motor vehicle laws.  You don't hear me whinging on incessantly about it or asking if the cop was somehow wrong in giving me a ticket.  That's what "your day in court" is for.  Use it.  You'd be surprised how many "25 over" tickets end up becoming "defective speedometer" tickets, and if they weren't pulling over people at 3 a.m. for failing to signal, we might not have "COPS" to entertain us with endless car chases to the Mexican border on their rims.

In MA, it's indicated right on your plate, when your registration expires.  You get a sticker when you register and it has the month and year of your expiration on it, that goes on your plate.

Same in OK. Actually, you're lucky it didn't happen here. If you get caught driving an unregistered vehicle here, it will be impounded until you get it registered.

Yeah, I'm not sure how that would work here. The local cops are mostly 22 year old buzz-head aholes, so they'd probably impound it.

My town is really small, about 7000 people.  The cops are decent to the residents, but will be pretty aggressive with people passing through or here from out of town.  We have a massive outlet mall, a harness racing track, and two major highways pass through our town.  They have plenty of nonresidents to hassle.

yeah it was your typical early 20s cop, you could tell he hasnt been one long just by the way he talked and did things he didnt have much confidence. Its just ridiculous how cops around here just harass people with "hot looking" cars, i dont drive like an idiot i save it for the track, when i was 17 i used to drive like that but not anymore and i had a different car then

getting pulled over when your young is part of growing up.  it sucks.  i got a ticket  for no front license plate in a brand new corvette once.   wasn't even driving.  sitting in the car in a driveway.  probably because i was a snot nosed punk who couldn't afford the car, but my father could  :P

A mate of mine told me recently that in Australia (state of Victoria at least), if you're just driving along, not doing anything against the law and the cops turn their disco lights on, you are NOT obligated to stop.
Most people who do run from cops get caught for speeding, running red lights, dangerous driving etc... but apparently not for refusing to stop.
This was told to my friend by a cop he knows.

I'm not going to attempt a low speed chase myself since my car has a few minor technical problems which they could turn into big technical problems but i'm wondering if there's something similar in other countries.

Funny thing is, I've actually been pulled over by the cops when I was walking home from the train station at 9am. They got really stroppy cause I had no ID (I didn't have a car at the time so no license) and threatened to take me down to the police station to run a check on me. I asked if I did something wrong, they said no and I walked away.

---auto censored--- the police.  :police:

Wow, sounds like they hassle you every time you take a leak.  Maybe you ought to stop walking around covered in bloodstains.

im going to stash a power pellet in my driveway, so when the cops are chasing me there i can eat it, and then they all turn blue and i turn around and eat them

Oooh that would be worth watching:

"Sir, what exactly are you doing?"
"Ummm, trying to eat you."
"And why would you be doing that?"
"I just ate a power pellet!"
"And....."
"Well you turned blue so I figured I could just gobble you up and get 200 points."
"Sir, we are all in blue, they call us the 'boys in blue'".
"Oh, so you're not edible?"
"Not by you sir.  Hands on your head.  While we're at it, who did you buy this 'power pellet' from?"
Back for nostalgia, based on nostalgia.

Same thing happend to me sometime ago, i was driving so fast that the only time the cop had time to pull me over was at my house when i had stoped. I ended up getting a Field sobriety test done on me in my own driveway and was none too happy but felt lucky to walk in the house a free man with no ticket.

Actually in a whole lot of places it IS illegal to have a vehicle parked with expired plates where it can be seen from the street.

In some places it is illegal merely to own an unregistered vehicle.

My neighbor had her vw van towed from here driveway because it was unregistered.  I had my brothers truck w/ valid registration get a notice to have it moved with it parked on the street.  In this part of texas all you have to do is call and complain about a car that hasn't be moved in awhile.

And the wether or not he can give you a ticket is up to local and state laws to decide.

here's a local story of police that arrested two men in there driveway after a chase. The cop only got suspended
here is a quote telling what led to the arrests
Quote
"It is important for everyone to know that Hispanic citizens flagged down the officer and told him the vehicle the men were traveling in was the suspect vehicle in the shooting," he said.

Swindle said that when the officer tried to stop the vehicle occupied by Gomez and Romero, the pair sped off.

"They were traveling about 50 mph on wet streets, traveling in the left turn lane and they spun out. They then went the wrong way on the up ramp at the Front Street overpass before turning onto Clayton," he said. "I am not trying to justify any of the officer's actions, but I am trying to show that officers responding to a shooting believed these two men, based on information they had received, were armed and had just fired shots at a home where children were present."

Swindle stated the video showed that Romero was not hit in the head with a flashlight or his head slammed into the truck's dashboard.

"He was out of the truck with the door closed when the officer approached him. It is on the video."

Swindle explained he would not tolerate any wrongdoing in his department.

"This is a serious allegation and I don't want an officer accused of using excessive force on the streets patrolling until the matter is cleared up," he said. "The investigation has been given to the district attorney and they will decide if it will be presented to a grand jury."

What, you think your house is "safe"?  What if you were driving like a bat outta hell, cops were chasing you, and they lost sight of you seconds before turning into your driveway?  No ticket because you weren't tagged out before reaching home?
Yes.  I believe cops can't enter your house unless invited or warrant.  That is the purpose of a warrant to uphold that one amendment.  But yes, he wasn't in his house in this case.
But in this registration case if it is ok to have an unregistered vehicle on your property then you just need to ask the cop if he has proof you were driving it unregistered and to produce it.  This is a country that still thinks innocent until proven guilty.

Quote
I got MANY tickets due to my breaking motor vehicle laws.  You don't hear me whinging on incessantly about it or asking if the cop was somehow wrong in giving me a ticket.  That's what "your day in court" is for.  Use it.  You'd be surprised how many "25 over" tickets end up becoming "defective speedometer" tickets, and if they weren't pulling over people at 3 a.m. for failing to signal, we might not have "COPS" to entertain us with endless car chases to the Mexican border on their rims.
Right, court is one way to reverse a ticket.  Another is to ask for the evidence of guilt.  If you get pulled over for speeding you better ask the officer for proof.  If they didn't have their radar turned on and you were just going faster than the rest of traffic they will probably leave you alone.

Here in ohio, if you are drinking, and go out and sit in your car (no keys, no engine on) you can be arrested and charged with DUI.

I came to the conclusion a long time ago that cops are pretty much worthless revenuers for the municipality that they work in.  They love to harass kids in cars, while complaining that the public is losing support for them.  Duhh.  They forgot that people remember what cops did to them when they were kids.  They appear as if out of nowhere for any traffic infraction, but take up to 2-3 hours to respond to a 911 call in my city.
I got a ticket in front of my house on the morning of Easter Sunday for being 7 miles over the speed limit.  I asked the cop how come they never respond to the neghborhoods complaints about cars doing doughnuts every Friday and Saturday night through our neighborhood.  His response..."We don't do traffic enforcement after 6:00pm."  WTF?
I went to court, knowing I would lose, just to vent about the doughnut and crime issues.  The judge said he understood my frustration and reduced my fine by 50%.  The cop gave me the laser stare, and I bet he just can't wait to see me again
Please!  Give me the good news first!

I agree with Geo, at the end of the month all I see is cops giving tickets or waiting to give tickets to make a quota, now that is in the suburbs. Chicago dosen't have quotas and the cops are generally real cool unless you cut them off bad.

ok, I can see that then.  Here in WI it isn't uncommon to see old vehicles sit out on lawns growing weeds around them.

and you should see DREWS place!

I grow cars in my weeds?

Tell ya what though, once they figure out all the older classic cars are to be found in WI since we don't have THOSE dumb laws, some frog-lickin' dirt-eater will push for that law to be passed so we have to scrap all the cool cars.

Even if Seph had been in his house it would depend on the circumstances whether they would need a warrant to enter.  The Supreme Court has recognized a lot of exceptions to the 4th Amendment.  Hot pursuit is one of them.  So if, for example, the Cop called Seph over and instead of complying he made a break for his house, thinking that he'd be safe once inside, that cop would have walked right in after him.  Had he just been a little quicker and got inside before the cop was able to get there and talk to him he could have got away with it entirely by simply not answering the door (assuming that it's not illegal where he lives to have an unregistered vehicle parked in your driveway).

Same in the UK.  In fact I think if you are in a car and have the keys while drunk you can be done.

I've also heard of 2 people who pushed their motorbikes home as they'd been drinking and didn't want to ride, and they got done for drunk driving.  Even though they weren't driving.  Or even riding.  This kind of thing is what makes people hate the police...some of the time they are just doing their job but the a-hole ones just like to piss people off.

Funny you should say that. Here it is creeping up toward the end of the month. On the way home yesterday I saw three obvious speed traps and two cops who had already pulled someone over. Watch your speed until after the first of the month.

Yeah, it is bad when they enforce traffic laws.

I love seeing people pulled over.  They set up a speed trap right in front of my house every few weeks, always after dark.  I can tell when they have pulled someone over by the flashing lights in my living room.  I sit there with popcorn and watch.  I've seen them arrest people, impound cars, give sobriety tests.  I saw them searching one kid's car, the cop came out holding a baggie, and the kid ran into the woods.  20 seconds later they dragged him out of the woods with a nasty looking cut on his head.  Apparently he didn't know that those woods go straight uphill and lead to a bigass fence with water behind it.  It was like my own personal Cops.  Sobriety tests are a riot to watch in person.

I need to get a police scanner so I have better audio.
