So there I am tooling around, and I stumble across this:

What the assocs do in this situation is simply deny any deniable request you ever make going forward.  You can't paint, you can't improve, you can't even have any parties that may violate noise rules.  They may not be able to stop the dish but they stop everything else whether they have reason to or not.

I smell a discrimination suit!  Clearly all those things would be discrimination if your neighbors were allowed to do similar things (and obviously they would), and as for the "noise rules", there's noise ordinances on the books in your town.  As long as you aren't violating them, you're good to go.  If you ARE violating them, then you're inviting trouble.

The solution?

Make SURE your kids go play at the community playground and "hurt" themselves there (see other thread for follow-up).

What is "exclusive control" areas?  Like my lease on my apartment says I can't put up a dish.  I live on first floor and have a cement "patio".  That's outside, do i control that or the landlord?

I've been wanting to do the free dish thing I even have a dish coming my way.  I was thinking since I have a south apartment I was going to put my dish up in a window inside to see how well that would work.

Buy an RV and park it in front of your apt, and put the dish on that.

If they can put it on your patio, you can do it.  A lot of places say you can't put one on top of the structure itself (they don't want it crapping up the "look" of the roofline) but you can put one on your porch.  It's considered part of your dwelling. 

If they have to drill into the concrete, however, I think THAT'S a different story, and the yard beyond your patio is considered "community property", I believe.

And I knew somone who DID have it inside their house, and it does work, but for such a small dish, it takes up a LOT more room inside than you'd think!

If you've got a railing on your patio, they can affix your dish to that, or see if Paige will borrow you his RV

I know someone who put the post in a bucket of cement like a street sign.  Worked very well, except when someone moved it.

I did the pole in a flower box with cement at my condo for years.  it never moved.  in fact, it was heavy to move when i had to toss it out.

If you don't mess up their building, they can't say anything.

I couldn't do the railing mount because the railing was a piece of junk.

I don't think it will work behind glass.

their power is ridiculous. even though you can legally, they could try to sue you and you have to pay their court fees no matter what.


That's why, if they feel the need to see who's King Shite of Turd Mountain, you counter-sue.  That way, THEY have to pay those same fees, AND more than likely will be found to be violating your rights in some way, AND have to pay you whatever the judge deems a fair settlement. ;D

You cannot countersue, it's part of the agreement you sign when you buy in.  The document is VERY onesided, for whatever reason people always sign it, then when they have a problem discover they have forfeited half their due process rights by contract.
