There is a seller on ebay that is actually selling (or trying to sell) and Emulator and roms pack on ebay. Where is the flag button on ebay?

You know, now that mame is officially open-source, I wonder legally what one can do in this situation?

I would get in contact with Dave Foley, and he will get Ebay to shut the seller down.  Since Dave apparently created Mame, and was tragically denied the copyright to the multi game enulator, his legacy lives on forever as being a decent and honest individual of the video game industry.

I think you can contact him via a prison in Nevada.  Dave Foley knows all about the technical complexities of selling games on Ebay.  I am sure he will revel at the chance to recreate his glory days, by assisting you.

If it is like most of those listed on Ebay - they are selling the USB drive or HDD with the MAME setup ( It's now open source so is able to be installed on hardware and sold ) and if you look in the details of the listing it will usually state ( " PER EBAY RULES THESE DRIVE CONTAIN NO ROMS, EMULATORS, VIDEO, SOFTWARE, OR APPLICATIONS. " ) So they do not actually include any of those files just give info on how to obtain them with the sale - so pretty much just selling freely available information along with empty hardware to use to place it on.

Lol.  Right.  99% of those come with a full set of roms accidentally installed.

Yeah but there in lies the problem.  The person buying the roms obviously isn't going to turn them in and the only way to inspect the hard drive is to buy it. 

I don't think anyone cares at this point unfortunately.

The best part is that you don't even get a hard drive. You get an email. Probably a link to a download.

What's unfortunate about it?  If companies cared the mame team would be doing hard time.

Well the developers work hard to make games, the mame team works hard to make the emulator, and some idgit with access to a romz site is the only one getting paid. 

Not that I think emulator developers should get paid due to the copyright stuff... ideally it should be free.

Yeah, the top hit for 'arcade' on the Google Play store takes you to a modified version of MAME that has its own ROM store.  I was impressed by the brazenness.
