As far as I know, modding a game console is not illegal. Can anyone tell me otherwise? ROMs and selling "game backups" are plain flat illegal.

Some of the stuff that SNAAKE has stated was included has to be compiled with an official XBOX XDK and in order to DL them one must obtain them in the "back alleys" of the internet if you know what I meen...
-
Modding an Xbox is NOT illegal and, in fact, you can simply go to one of a dozen or so well-known websites and order a modchip online. Clearly there are a lot of illegal things one can do with a modded Xbox, but as long as Snake isn't putting pirated games on his customers' Xboxes he's perfectly safe. Even putting software on there like a new Dashboard or Xbox Media Center, while compiled with the Xbox XDK only hints at being really illegal. The Xbox Media Center guys have even approached Microsoft about turning it into a legitimate retail Xbox product. MS turned them down, but have never threatened them with legal action.
-
Good luck with that Snaaake.
By the way, I have a softmodded xbox and also a larger HDD. You have to look around a bit more, but there are soft mods that support that.
-
yeah I know it can be done..I just choose not to. I'd rather just put a chip in there or flash the xbox board.

Putting an actual modchip into an Xbox is not illegal, but using any sort of BIOS with it (or for soft modding/TSOP flashing) that allows it to do the OP's advertised features definitely IS.

huh? I didn't tattle on anyone.
I was stating fact in reply to Saint's post.
But since we are on the subject...
I have nothing against anyone that mods their Xbox. Heck, my "mame" cab is running off an Xbox of the "special" variety.
That doesn't mean that this is the place to advertise such things though. Is SNAAKE, making money with these mods, important enough to you, to put this site in jeopardy?
Simple fact is that it is illegal. Whether I love modded Xboxes, you love modded Xboxes or the other guy loves em doesn't change that fact, and posting the service here is not much different than posting a link to roms. We all have roms, and we all love playing em, but we accept that helping their distribution from here is a bad thing, so we don't do it.

Curious, other than an EULA violation (which is arguably breaking the law), why would a different BIOS be illegal? Are we talking DMCA "copywright circumvention"? I've not heard this and would be interested to know the position.

Because any bios that will still allow you to run Xbox games is compiled with a pirated SDK, and as such has pirated code in it.
Same goes for any apps that you can run on a modded Xbox with that bios.

Well, I do know that there are legal bioses out there, and legal programs. See this link for some examples: http://developers.slashdot.org/article.pl?sid=04/10/09/1640258&tid=156&tid=211
Do I have any idea of how the bios I am using was created? No. I am a programmer though and can think of a few different ways of making the "new" bios call the "old" bios calls so that games will still run. Unless there's something I'm unaware of, the games don't really need the proprietary BIOS to run, just the correct library calls.
Anyhow, it doesn't make it illegal just because it exists.
I am interested in more information if you have it on why xbox games can't run on anything other than a bios built by the MS SDK.

there are legal bios and I will use those.
OK !

I lurk on these boards a lot but I haven't posted in a while. I recently have been gaining interest in modding my Xbox (mostly because of shmokes) but I don't have the soldering skills necessary to install a flash chip and I have never trusted the soft mods/solderless chips.
My question to you SNAAKE is; do I have any reassurance that I will not be screwed over on this deal? As I said, I frequent these boards a lot, even though I almost never post, so I know your reputation and trust you. My parents are a different story. They have problems with me sending my Xbox to a stranger with $60 and for a good reason. So is there any way I could ease their minds?

What? Your parents don't trust a guy named SNAAKE?
What the heck is wrong with em?
;D

I fixed "wazcrackin's" xbox that was messed up from a poorley soldered chip. and I moddded "markpv's" xbox. both memeber here, you can ask them I guess. I also did business with like 30+ members here(non xbox related).

Yeah . . . Snaake's good for it. He's been around here for ages. He used to make a ton of arcade controllers to be hooked up to various systems. Probably built up some decent soldering skills hacking all those controllers. Anyway, if he couldn't be trusted it'd have come out long ago. He's seems to be offering a good price and doesn't seem too concerned about getting arrested, which is nice cos you can probably ask him privately to load a BIOS and XBMC and emulators and so on (all made with the illegal XDK Versepak mentioned), which actually takes A LOT of research if you're doing it all yourself for the first time.
That said, solderless has come a long way. I've used lots of Xenium Spice chips on other peoples' Xboxes cos I was afraid to solder on an Xbox that I didn't own. They've been pretty solid, and someone here gave me the brilliant suggestion of hot-gluing everything once it's all installed and running. The SmartXX solderless solution looks really good too (possibly better since it doesn't use pogo pins, which are by far the flakiest part of the Xenium solution, IMO).
Anyway, though I haven't done any business with Snaake, it seems pretty clear that you can trust him not to take your money/xbox and run.
-
I think you can trust this guy with your xbox.
