to answer the question,  no, it is not allowed on ebay and the mame trademark prohibits it with use of the name mame or the logo.  if you report it the auction would likely be removed.

monkey another member pm'd me with the same idea of reporting it .....I have done so, I plan on watching to see if ebay does the right thing.

FYI, there's a sticky at the top of the forum with the rules.  The B/S/T forum's rules specifically state on the third line:

I thought you couldn't report these to eBay anymore? There tattle-tale  ;D link now states that only the copyright holder may report copyright violations.

Otherwise, I'd report every-one (and their mothers) for the sales of Tick Animated DVDs (mostly ripped from VHSs they borrowed off the web).  For one thing, the quality sucks (I know, I encoded several of them)... and second its discouraging Fox from releasing a true DVD set of the series.
