In Arlington, at one time, the city had put up those "speeding camera" down the middle of a busy thruway.

Everyone hated them, but, there they were, till some guy got a ticket for speeding, and the city dutifully sent a picture of his car, the date and time, with him and someone NOT his wife in the front seat, to his house....

Needless to say, there was a lawsuit, he won a big chunk o change and the camera's all came down.

I'm just wondering how long it'll be before someone takes a photo like this but of an identifiable person, who then turns around and sues the cell phone maker for putting concealable cameras into cell phones.

Or has that already happened and I missed it.

Oh, and the cameras a back up again, now. but they're at stop lights, the only photo the tail end of your car with the license plate, you can't even see anyone in the car, and the tickets are civil violations, not moving violations so they don't ping your insurance (supposedly, though I'm guessing it's just a matter of time before the insurance cos figure out how to link up with that data and "adjust" your rates accordingly  :(

If your car has multiple insured drivers, wouldn't they have the burden of proof regarding who was driving?

As for the camera lawsuit question above... Nope. When you are in a public place you cannot claim any expectation of privacy. In fact, in many places, if you stripped naked in front of an open window, you again can't reasonably claim your privacy was violated even though you are technically in your home.  The only reason the cheating guy won was with a very good lawyer, and probably arguing that the city's actions in SENDING THE PHOTO TO HIS HOME precipitated events that harmed the guy. The taking of the photo itself is not "illegal".
