I guess Arcade Hollywood is branching out

Nope..... I would bet money it's just a MAME setup.
They are including 145 games, but also mention the fact that you can add more games.
Also if you look at the list of "supported games" on their web-site then it's even more clear that it's a MAME setup.

So where they are getting this "licensed" statement is unclear and probably bogus.
Licensed to someone... yes. Licensed to them.... I highly doubt it.

Would it be illegal to sell them the arcade only and say the ROMs are included free of charge? If your not selling them, its not illegal, right?

Good point, could be a number of reason for that though.
Modified, scratch built, who knows..... still illegal.

Oh, don't get me wrong. ArcadeHollycrap is the Anti-Christ of this scene. They are all that is bad about MAME and the ability to create working arcade machines with a PC. If the son-of-a----smurfette--- who runs the place was to step off the curb and be hit by a speeding bus the only thing I'd feel bad about is the fact that some poor schlub would have to clean up the mess.
...that said, at least it's likely not an original DK cabinet.
