Legal question on a website not disclosing their TV's are refurbs.

Yes.  It is illegal.  You've already started the chargeback process, but notifying the AG is a good idea too.  At least you can be happy knowing that the company will have to eat the shipping charges.

How does he do that when he didn't know it had an issue?  He found out it was a refurb by using it, it failed, he called the manufacturer, who then told him it was a refurb.

I don't think that he used the TV, or that it has been delivered yet.

Sounds to me as if he purchased a TV back in Feb,  and that it died on him...
