OK, I'm not entering this thread more than to say the following...the TM is not indicative of a registered mark. The TM is the symbol for a common law mark that anyone can utilize merely by doing business. The registration symbol is the R with a circle around it. Note that SlikStik was using the TM and in doing so was not illegally indicating the presence of a registered trademark. SlikStik has every right to do this and claim property right in the mark.
Too much is being made of the abandoned registration. These happen all the time and for many reasons including among other things merely not wanting to renew at the end of the five year life of the registration. Here, oddly enough, the application for registration was never granted because they filed under an intent to use statute and never submitted evidence of use. I say this is odd, because any sales receipt would have been sufficient...guess they were to "busy" to bother. Anyway, the abandoned application came as a natural course that began in around Sept 2005 when this showing was first recqested and March 06 when the first abandonment occurred.
