First, I received a postcard from "Essex Special Civil Part, Hall of Records - Essex County" concerning my lawsuit vs. SlikStik and it read:

"A summons was issued 12-20-07 and a non-jury trial has been scheduled for this case on 02-20-2008 at 9:00 AM.  Bring all records & witnesses.  Please report to:  Judge Judge, Court Room: 301H."

I'm hoping that the judge's last name isn't "Judge", if for no other reason than the fact that he/she must have been teased incessantly in law school! (I'm guessing that a judge won't be assigned until much closer to the court date).  Anyway, it looks like I'm taking a road trip to the Trenton, NJ area in mid-February.  I'm going to drive out (8 hours, yikes!) during the day, but will spend the night so I can get some sleep after that long drive and be fresh to face the judge the next morning.  Any members from the Trenton area than can recommend a good, yet cheap, hotel for just the one night?  And where is the courthouse?  I have TWO addresses!  :-(

Odds are they won't show. What happens then, do you win by default? Do they have a set time to pay up before a legal issue? Just curious. Also, are you including your travel expenses in your lawsuit?

If no one from SlikStik comes to the courthouse to dispute the claim, I would win by default. At that point, SlikStik will be advised, in writing, of the results of the trial. After that, they will have 30 days to dispute the result.  After THAT they will receive a final notice at which point it's just my guess at to what will happen. According to New Jersey state law, they could suffer liens against property, etc., but what that REALLY means... who knows.

It goes without saying that I will do whatever it takes to get my money back, within rule of law. If they think that by ignoring this that I'll simply back down, they are sadly mistaken.

As far as your other question goes ("...are you including your travel expenses in your lawsuit?") the answer is no. I HAVE included my fees for filing the lawsuit in the final judgment, but from what I read, I don't think I'll be able to recoup travel expenses (gas, hotel, etc.).  If anyone knows otherwise, please contact me.

No offense to Scott or Mameroom, who have always shown themselves to be honest decent guys... BUT...

Of course he was only an employee of the company!!! Every Director, Partner, CEO, Chairman etc etc etc of an LLC (same as Ltd or PLC in the UK) is only an employee of the company.

That doesn't mean that those company officers can't be held responsible for fraud commited while they are in charge of it.

The only liability exemption it gives them is exemption to the valid debts of the company. However!! Debts occasioned as a result of fraud perpetrated by them, they are NOT exempt from liability for and they can legally be held personally liable for. He knows that! stop trying to defend him.

As for any new business the shark sets up.... we want to know about it straight away, so we can issue cautions! as (no doubt) will his former suppliers, who I suspect will not want to deal with him or whoever he uses as a front man to try and hide behind.

Three words for vendors dealing with Christian: CASH UP FRONT!!!

I hope everyone's holiday season is going well.  We're less than a week from 2008... boy does time fly.

I have an update for everyone, and I fully intend to keep you posted as things develop.  Christian contacted me a week or so ago by e-mail, much as he did M37R01D.  I had a chance to speak to him for nearly an hour on the phone last night, and we talked about posts in this forum as well as elsewhere, what his plans are for the future, and so-on.  I think his plans have already been stated on here in an earlier post, so I won't rehash all of them. 

In a nutshell, Christian has begun the process of making good on the orders left at Slikstik.  Mine and M37R01D's are two of those orders.  I know that there has been a great deal of mistrust generated by Slikstik, and I'm just as skeptical (actually, odds are I'm more skeptical) as the next guy.  Here again, I'm not yet going to elaborate on anything other than the promise made to me by Christian--to order my overlay, put the panel together and ship it to me (hopefully) next week, or the week after at the latest.  This is a fair attempt at beginning to make things right, so I'm willing to give him the chance to do so.  As mentioned above, I will post on here to keep everyone updated on the progress of this promise.  The results will certainly dictate how I respond to this situation, and I hope it is positive.  This gets my panel to me, but I also know there are others out there still waiting, and I also want to see if this good will continues.

This is all I have to say at this point, but I will elaborate more as time goes by and things progress.
