Visa and MasterCard prohibit surcharges, and American Express discourages them. Amex does prohibit "discrimination" against the Amex card, however, so if a merchant accepts Visa and MasterCard (and cannot impose a surcharge under those companies' rules), the merchant may not discriminate against Amex by imposing a surcharge. --- End quote --- And for those who aren't sure how to use Google, a couple links: http://www.alligator.org/pt2/050901charge.php --- Quote ---Florida Statute 501.0117 states a seller "may not impose a surcharge on the buyer or lessee for electing to use a credit card in lieu of payment by cash, check or similar means, if the seller or lessor accepts payment by credit card." --- End quote --- http://seattlepi.nwsource.com/local/241548_wellspent21.html --- Quote ---THE LAW ON SURCHARGES States that have outlawed surcharges for using a credit card: California Colorado Connecticut Florida Kansas Maine Massachusetts New York Oklahoma Texas --- End quote --- http://www.fightback.com/everywhere/index.cfm --- Quote ---Fortunately, a number of states have outlawed surcharges for using a credit card: They are California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma, and Texas. --- End quote --- http://www.ago.state.ma.us/sp.cfm?pageid=1179 --- Quote ---Q: A store charged me a $1.50 surcharge for paying with a credit card. and just to give peale a bump and add something. it's also illegal for stores to ask for a minimum purchase amount (say $10) on credit card sales. that is mastercard/visa/amex's doing and you can call your credit card company (if mastercard) or visa/amex directly if visa/amex and report them. |
