Damn 20 years and a fine, that does suck (if he is guilty).

That is for just one of the charges.  The other charge carries a possible 30 years and bigger fine...  so the dude is looking at a possible 50 years + fine.  THAT SAID,  he did plead guilty...so there IS a deal on the table.  I'm guessing he'll get away with a big fine... or possibly a small jail sentence + fine.

@pinballjim, is that sarcasm? Can't quite tell.

Based on the article, Foley pulled some pretty bold moves, plus since he had an accomplice across state lines, that drew in the mail and wire fraud charges, which gets into the federal arena.

Plus, sounds like he misled a bank to indicate he was employed when he wasn't.

And, he's already plead guilty, so it sounds like there is no question of guilt.

Still, possible 50 years for that, and yet the guys that led Bear-Sterns, Goldman Saks etc, walked away without a care in the world (and a huge golden parachute)?   :angry:

I hope he used the proceeds to pay off smaller creditors (vendors, business partners, credit unions).

I do as well.  It should serve as the perfect reminder though that people DO care about commercial distribution of ROM's (although this case had other things going on as well).

It's too bad really because as much as we "debated", we actually agreed on the basic issue of distribution without consent.  I imagine it was a "if you can't beat them... Join them" type of decision he made although I don't know the actual timeline of when this all happened.

If he was smart (and I believe he is), he'd try and lower his sentence by providing information leading to the arrest of others doing the same thing.  Even if he didn't lower his sentence it would make the evil-inside smile a little if he knew someone else was being put in the frying pan.

Anyone wanna start a betting pool on the length of his sentence?  I'd personally put the over/under at a year.

Goal '92 was featured on a number of flyers / adverts.

It's a bootleg.

You can't license a bootleg, there is a mix of hacked code owned by the original manufacturer (from which they don't appear to have any other games licensed either..) and code written by the bootleggers, as well as stolen music / sound effects from another game entirely.

That's not something you can include in a commercial product, period, yet it was.

Furthermore, if you had an official license, you'd likely be supplied with information / resources to emulate the original game / hardware, including information on the protection devices (Seibu Cup Soccer still doesn't work in MAME for this reason)  I actually see very little evidence that the guys doing their emulator software were capable of actually emulating anything from scratch (as in figuring out how things work) tho, so maybe even with original information they would have struggled.  At worst it could have still been better disguised to look like the original tho, for example taking the bootleg patches to the protection and applying them to the original game.

I suspect there is still plenty more dirt to be dug when it comes to Ultracade, Foley and the whole saga.

i remember reading someplace that he used the proprietary software (that global now owned after he sold ultracade to them) to generate installation codes for some of the game upgrades he was selling, or something along those lines. his ideal was that they (Global VR) bought rights to the UltraCade name but hadn't done anything with it for like a year, and he was all like" hey i might as well make some dough off this...need to feed my family and all" and made the game packs for ultracde... where he thought "ultracade" had no longer existed since global never did anything with it.

don't forget at this point, Foley was working at global still.

Global found out about Foleys hand in (almost theirs) cookie jar and screamed "rape" so technically it WAS counterfeited software... but (not defending foley here buuuuuut...) some of us know globals propensity for abandoning their projects and leaving their customers hanging... coughallofthemcoughcough i would have thought a company had abandoned it if they didn't finish completing the transaction... but it appeared to persons buying the product that it would have been authorized for use when it wasn't

i think the only reason for globals continuation of the "ultracade/arcade classics" is so they can stick it to foley.

BUT

these new charges have nothing to do with the first set of charges (counterfeit game deal). (well they kinda do) this all had to do with fraudulently obtaining bank loans (by saying he still worked at global after he had been fired for the counterfeit software dealy... actually, it was at about the same time... his getting canned happened to be JUST before the loans had been closed and had to have someone (not from global) call in for him and (fraudulently) verify employment.)

If you're going to that trouble, you might as well covertly video and stream it.

Incidentally, I play an Ultracade today, and was un-impressed with the emulation consistency (under-powered hardware?.....), let alone that you see the boot screen of the PC bios.

And that Dave has his own legal problems.  He has been kicked out of Canada by the courts.  He has an ex-wife and a few kids.  The ex left him when he was staring in his TV show, and child support is based on how much he made then.  But it can't go down (really, the law states that.  because a ton of guys would just get a crap job I guess to stick it to the ex-wife)...  So after a few legal battles, he isn't allowed back in the country or he will go to jail...  All because his wife left him at the moment he made more then he ever will again.

Sad thing.  She/Kids doesn't get anything anymore.  Because there isn't a way to pay just a reasonable amount for an grade b actor after he was getting grade a actor money.

pretty messed up system.

It sucks to be him today, but I just can't feel sorry for the guy. He brought it upon himself... Over and over and over. Yeah, it's just video games, but he burned a lot of bridges and (more importantly) broke laws... All the while knowing exactly what he was doing was wrong and choosing to do it anyway.

Are you confusing Dave Foley from Ultracade (and multi-million dollar home financing fraud) and Dave from RAM Controls ?

Dave Foley's biggest asset is the over $1 Million in salary he has been accruing from a company that made less than $50K last year. Wouldn't hold out hope for that if I were him.

Didn't Ultracade sell CDs full of ROMs and stuff not too long ago?

Every once in a while when an ultracade question popped up on here, he'd post and try to help the person.
I do think he deserves some credit for that.

I really just urge you guys to read the legal document that came out in January.  While his two convictions were pretty narrow, he admits to a lot of wrong doing.  The convictions were level 20 and 22, you can take a look at what he's facing here:

While the press release of the agreement cited a maximum of 50 years, my recollection is that the plea agreement has a maximum of 41 months. I can't seem to find the actual plea agreement anymore.

It is billed quarterly, so if it doesn't add up to $15 in the quarter, the fees are waived.

The one Ultracade I've seen "on location" was such a pile of crap that I just walked away from it.

Mostly due to neglect - it was just tired and needed to die..

I believe the wager was $5, and my position was that he was going to spend at least a year in prison.  Maybe it was six months.  I'm comfortable with either.

Document labelled 117-1.pdf in your attachment is quite the laugh riot if you need one.  I'd sum it up as "nobody died and I didn't know it was illegal."

He's going to do some serious time.

If you believe him, it was to prevent anyone other than MAMEDev from using it.
If you believe MAMEDev, it was so he could either market his own stuff using the MAME name, or destroy MAME because his own Ultracade machines would be worth more without MAME on the scene.

I tend to believe he wanted to stamp out competition.  I cut him some slack for being helpful to Ultracade owners who have posted here with problems.
EDIT: I don't think anyone here has an axe to grind from any personal dealings with him.  This isn't like Dave whatever his real name is at Ram Controls.


The third document lays out pretty plainly how the charges arose.
After taking over sales of Ultracade products, Global VR wondered why the distributors weren't buying game packs so they called them up.
Turns out they were still buying game packs from Dave.  :lol
Fired next day, then they sicked the FBI on him.

Sounds like a fustercluck of a merger where he tried to sneak millions of dollars of debt into the deal without them realizing it until the last minute.

He had to delete all his posts to get rid of any time stamps that would have been during work hours.   ;)

The irony of the whole MAME trademark thing is that it probably isn't even valid anymore.

Unlike copyrights you actually have to actively defend trademarks against abuse if they're to remain valid, and that hasn't been done (at least not in any effective capacity)

If he wasn't actually operating his own not-exactly-legal schemes (which he may or may not soon be paying a heavy price for) I dare say it might have actually been better off in his hands.

He's got a family to support and there's not really a victim here, IMO.  No dispute that kind of wrong doing isn't conducive to society but I certainly won't take much pleasure in seeing him receive a prolonged prison sentence.  It's still kinda funny, though.

You have an excellent sense of humor, friend.

Was riding the clock anyway, so I skimmed parts of that interview.  At one point, if I understood it correctly, he claims they bought up several hundred Nintendo boards and stacked them in a garage so that their ROM counterparts in the Ultracades were legal.  (Setting aside the fact I don't believe him....) Ugh, really?  We're back to THAT argument?  Yeah, no.

He's got a family to support and there's not really a victim here, IMO.  No dispute that kind of wrong doing isn't conducive to society but I certainly won't take much pleasure in seeing him receive a prolonged prison sentence.  It's still kinda funny, though.
the victim is the public trust.  its one thing to be a bootlegger, or a thief, but what he did was to sell his stuff as legal, so the people who are honest, the people who want something legit, something that isnt stolen, something that is legal, would buy from him.

anyone and everyone can steal and use arcade history any way they choose.  his way was to fraudulently pretend to be legit, so people looking for a legit option to mame would pay him for his product.

in my mind he is no better than someone scamming old ladies for investment oppportunities or someone setting up a fraudulent charity operation.  the ONLY reason people bought from him is because they believed he had the ONLY legit license to those games.

so, he's at the bank when the bank wanted to "verify employment", he had them call a friend of his and have him state he was whoever from Global VR and that yes he was working for Global VR. The bank found out about the sham and promptly began proceedings against him.

He claims the guy who was in charge at Global VR at the time has a personal vendetta against him and sicked the FBI on him for both selling Ultracade gamepacks and lying about his employment during closing.  I dunno, but that's what is there.

I think its a little bigger than this.

 On a site that posted the relevant information,  it claimed to have called up or emailed certain companies in Japan, asking to see if Foley had negotiated the rights to certain games.  They said No... had never heard of him.

 On that webcast... he mentions that when he couldnt get the rights... he went online to ebay, and bought older PCBs for the roms.   He figured that if he has the PCBs... he should own the rights to the games.  Everyone wants to believe this... but Im not so sure that is the case... most especially when you are re-packaging something commercial for sale.   Imagine trying to sell a used Sega Genesis game in a new bartop arcade box at Sears, without asking Sega...  but just putting the cartridge inside the thing.

 Then to find out on top of the fact most of his games couldnt be used, rendering his business model near useless...  he finds out that his Former is cashing in on his remaining territory.

 Because the IP was overseas, it makes it an International crime...  and because Global VR may not have known that over half their IP was bogus... (and now the info spread all over the net about it)  calling the FBI just may be within bounds.

 Its quite slimy, to say the least.

 
 Ohh, and no, hes not the one behind 4k tvs.  He just managed to capitalize on a MGFs faulty chip, and used another MFGs chip to get his foot in the door.

Is he being sued for copyright infringement?

Has Nintendoh or Sega filled for damages?

You can get away with selling ROM chips if you hot glued them into the cabinets and used mame or Joshua to run the said game as it would be construed as fair use, especially if the board was deemed obsolete and the ROMS was considered as backups.

Besides we have gone down this route before.  Foley is being pinched for securing loans under false pretenses.

Unless you have found some evidence that contradicts this, and should be reported to the necessary authorities handling Mr Foley's case.

He has never let the facts slow down his opinions.  I actually bothered to read the links from the first 2 pages, and the charges were for using the ultracade name and selling items as official UltraCade items when he didnt have the rights to, and for lying on bank loan applications. Nothing I read specified copyright infringement of ROMs.

 I was basing my speculations on the Former things Ive read in a past article.  One that contained a lot more of the factual occurrences.  Whether or not they can be made into a legal claims, thats another story.

 As for the Fair Use claim.. thats still highly suspect.   As Ive said.. you would never get the green light to sell used sega genesis systems with a cartridge in it.. packaged in an arcade shell.. in a RETAIL outlet..  without getting proper licensing permissions.

 If you wanted to ebay the thing... then sure,  you could probably do it without issue.   (Maybe not with Namco... cause anything with Pacman on it... and they go Berzerk)    Probably ok to do it in a arcade... because nobody is gona peek inside anyways.  (although, there are no arcades anymore)

 Im pretty sure Fair Use is limited to personal properties.. rather than commercial business ventures.  But Im no lawyer.   Honestly, Im surprised that Nice Carvings hasnt gotten copyright notices on their reproductions.  As far as Ive heard, many print shops wont copy / print things that have known copyrights... such as Disney characters.

i see company logos of like, Disney characters...comic book characters...etc and nobody is knocking down their doors with cease and desist notices. You know why? they aren't stirring the pot. they aren't trying to make money because of these characters.

i do however think that when companys capitalize on the character, IE, using the character itself to make money, they chance having the ---steaming pile of meadow muffin--- hit the fan.

You know - I had a few VPs in the company make similar comments.  "Every Identity thieves make loan payments"  and other comments on that line.  Money is money to that bank (now out of business).

really?  there are schools around here that have been forced to paint over Disney characters (provided to them by charity workers) due to trademark / copyright issues after getting attention in local news stories*.  Even if it's Snow White / Alice in Wonderland / Cinderalla you have to be very careful that they're not the Disney styled versions.

Disney is one the worst when it comes to this kind of thing over both trademarks and copyright and like to make it sound like they're doing you a favor by not just taking you to court.

The game companies are by comparison absolute angels, even EA / Blizzard.

* I have a feeling the papers contacted Disney hoping for some positive comments about the work done only to have it backfire completely.

I looked into trademark stuff (albeit north of the border) and one thing that was abundantly clear is that if you don't defend your trademark at every opportunity than it can be forfeited or at least legally challenged.  So while I dislike all those disney moments where they go after little guys, I get why they do it.  Failure to do so would open them up to all sorts of legal challenges by other "dave foley" types who try and get away with as much crap as they can.  I gave up on trademarking a name for no other reason than I didn't want to waste my time policeing it--it wasn't that valuable..
its better to not post and be thought a fool, then to whip out your keyboard and remove all doubt...

Just to clarify for those who don't have the time to read the stuff, he's never been charged with any kind of trademark or copyright infringement when it comes to the original IP holders of the games and actually did have licensing agreements with some of those companies.

He plead guilty to conspiracy to commit mail and wire fraud.   The fraud being that he sold gamepacks for the ultracade as being produced by Ultracade Technologies when he no longer owned the company or had rights to the name.  Global VR noticed that Ultracade gamepacks weren't selling, so they called up the distributors and found out Dave was still selling gamepacks himself instead of directing people to the new owner (and his employer), Global VR.
He was terminated immediately.

In the papers filed by his lawyer, he claims the sale to Global VR never officially went through so he's only guilty of using the name of a company which is no longer in existence.  On the flip side, he also argues that he ended up paying Capcom royalties that  should have been Global VR's responsibility based on the sale agreement.  :lol

That's a good summation, but I believe it was slightly more complicated.  If I recall correctly, he was selling the gamepacks through a third party on E-bay.  Some guy out of New Jersey? 

I can distinctly remember all the "our prices won't be beat!  at least $100 cheaper than other distributors!" stuff.

IANAL, but if commercial infringing activities are observed, I don't believe there is any need for the IP holders to make a complaint in order for proceedings to begin.  It is a criminal statute, so there is no need for the JD to get permission.  It would probably have to be fairly egregious to happen without their involvement, but not absolutely necessary.  Of course, once such proceedings began, and the IP holders notified, few if any would be turning a blind eye to the situation.

Probably not relevant in this particular case, but the earlier remark about it seemed a bit off.

Just to clarify for those who don't have the time to read the stuff, he's never been charged with any kind of trademark or copyright infringement when it comes to the original IP holders of the games and actually did have licensing agreements with some of those companies.


That would be because IP infringement is a civil offense and thus would be subject to civil litigation.  This is not a "charges" in this context.  If we're talking about being charged in this context it is because they determined it was being used to commit commercial fraud when he was selling it.  Just using someone else's IP is not criminal.  It is civil.

Bank fraud, on the other hand, is a felony.  That is very criminal and thus charges were filed.  Foley is facing severe criminal charges and also a heavy load of civil litigation.

It's very important to keep those two concepts separate.  It destroys the whole discussion to mix them.

If this garage full of boards exists then it could go a long way towards explaining why pcbs have gotten so much pricier since I got into the hobby.

It's straight across the board.  There's no way he has enough PCBs to affect the overall market.  Especially in your general area of b/w and really old games.  That's way outside of the Ultracade game list.

You get sentencing appeals even when you plead guilty?  Why tf plead guilty unless it's part of a deal in the first place.  I need to find out who his atty. is so I never ever mistakenly use them.  Perhaps some mandatory minimum or 3 strikes or something in play. 

Sadly I'm a bit surprised that people are looking at time for fairly rinky dink fraud of this level.  Hopefully its not taking up room needed for some murderer.

That's the American way nowadays..people like this get years in jail..while the guy on his 5th DWI gets a fine..  Hell you could kill someone while intoxicated in your car and never serve time.

Funny story on this:
  One of the people convicted on this whole deal was the owner of Automated Services here in CT.
I have a comercial customer that gets parts from them.

The other day my customer call the owner Mike (who had already done his jail time for this matter) to try and get Global VR parts and Mike told him Global VR is no longer in business.

Of course as it turns out, they are very much in business but they won't do any dealings with the guy who tried to rip them off.

He didn't fake his loan, he gave out in inaccurate information, so a mere technicality.  I did plead guilty and he is having a nice time there.  Maybe he will make up a game about the experience.

Hmm... not how I remember it but I'm not slogging through those documents again.

I wish I could tell you that David fought the good fight, and the Sisters let him be. I wish I could tell you that but prison is no fairy-tale world. He never said who did it, but we all knew. Things went on like that for awhile... prison life consists of routine, and then more routine. Every so often, David would show up with fresh bruises. The Sisters kept at him, sometimes he was able to fight 'em off, sometimes not. And that's how it went for Andy...er I mean Dave  - that was his routine. I do believe those first two years were the worst for him, and I also believe that if things had gone on that way, this place would have got the best of him.

This week our neighbor made us a great dinner with hummus, peppers, chicken, sausage and cheese, with some pita bread."

He's eating better in prison than I do on the outside.

I check in every once in a while.  The health updates make me jealous.
I'm here working a stressful sedentary job that's sending me to an early grave and he's spending every day reading, listening to music, and working out.
It sounds like a relaxing atmosphere.

He's in the minimum security "camp" next to the prison.  It's where the wealthy serve their time.
It doesn't even have fences.

I doubt it's as crazy as the guy in the interview says, but I'm sure it's the type of place where you can spend your days reading books and strolling the "campus" without too much worry.

white collar prison is a quite a bit different from blue collar prison.

"Prison Lite" life is like being stuck in a hospital you can't leave. same food, a communal area to watch TV, and so on.

it's a far cry from federal-bang-you-in-the-ass prison. "Cry" the operative word there.

lol, half the Indie authors on Amazon think their 12 page brochure they spent "all weekend working on" is a "book" and wonder why nobody more than their mother is buying it.  More than half the books published never get more than one sale.

It's already bad enough we're getting entertainment out of his incarceration.

Honestly I am a bit jealous.  I'm stuck working a job that is killing me while he is someplace where he gets to relax, read books & get in shape.
If he didn't have a family to take care of it would sound like a stress free existence.

Now we're coming up on two years so I'd imagine he's going to be out within another month or so?

I think he's only been actually incarcerated for about 6 months now. the rest of the time was spent dicking around in the legal system.

It's "white collar" prison, he's been good, and he's been doing all the things the powers that be think he should be doing whilst in there. I'm not sure how often reviews come up, but I wouldn't be surprised if when his comes up, he goes up for consideration.

Cause i would think that "back to work" is the last place you'd want this guy to get to.    :dunno

Last time I saw him was at CES 2014.  He was with an outfit called 4K or something like that was demoing 4K TVs. Coincidence?   

My guess he is back with them and will showcase some more of his 4K equipment.  I haven't seen the attendee list yet, so he might be there this year.

He has served his time and now is square with the house.  Hopefully things will turn around for him.
If I had only one wish, it would be for three more wishes.

You might be confusing him with Adam Judd, aka Dave Adams (alias) of Ram Controls fame.

Dave Foley is the guy behind the commercially sold Ultracade multi-game arcade machine.
He pissed a lot of people in this hobby off when he tried to trademark the name MAME for himself.
(he claims it was to protect the name, others claim it was to prevent his competitors from ever using it)
Other than that, he really hasn't done anything against the arcade community.
He has announced arcade related products and failed to deliver, but unlike Dave Adams didn't take money for pre-orders.

If you're an investor in his penny stock (NTEK), you might have other things to complain about....and they do.  :lol

Never underestimate the power of some well placed power strips.  Here in hillbilly land we don't add more breakers, we just shove a 3 way splitter somewhere.  Just don't run the toaster and the microwave at the same time.  ;)

Its a long story but in a nut shell:

The fire alarm went into pre alarm so I told the apprentice to man the panel and I ran off to investigate the cause of the alarm.

I burst into a tiny office in the corner of the warehouse that’s filled with bad smelling probably toxic smoke caused by aforementioned extension lead melting into a goopy flaming mess and aforementioned cock womble sat at a desk typing completely oblivious to the fact!!

Needless to say I called him some pretty stern words and left before H&S turned up to spit roast him!

That was always another bone of contention for me.
There was many times where I would be called to the call centre for the AC “not working/to hot/to cold” only to find the person who was to hot sat in a fleece when everyone else was in t shirts.

Needless to say eventually most of em worked out they got a Frosty response from me for being stupid and stopped asking.

I hear from my friends in management that dealing with HR is a treat though.

Nobody would hire me as a office dweller.

Apparently.....

going from road tech to office computer guy was  :dizzy: but hey at least I'm no longer spending my time in a stripped down van that was freezing in the winter and sweltering hot in the summer.

I do miss the 2 to 3 hr drives in the country one-way where I didn't have to listen to another person's voice.

Option A is leave the Engineer alone. When this is not possible, option B is to aim to get them to be OK with not being involved with the process/decisions. An engineer actively disagreeing with you is a complete impasse. Avoid at all costs.

 :cheers:  It is the truth. And for the record, I like all the engineers I work with. Even if they make my job crazy sometimes. Recent example:

I am building out training for a new equipment system we are developing. The system contains a chemical mixing chamber, a waste collection pan, and a chemical bottle that feeds into the system. I have develop training for our technicians to assemble. In the training, I tell technicians to connect the chemical jug to the hose that leads to the mixing container, and waste will be disposed of in the drain pan.

Engineer looks at it and rejects the training, because I correctly labeled the mixing container, but the chemical jug is really a chemical container, "Jug" is just not a term any engineer can accept, and the drain pan, is considered a "drain container", because of its parts classification it is too deep to be a pan.

So his proposal is that I train technicians to connect the container to the container that drains into the other container.  Thus began my two week journey that ultimately ended in creating a "engineer to technician" translation dictionary.

You aren't going to believe this, but honestly I prefer the latter explanation.  I would suggest you designate them as container a, container b, and container c to alleviate confusion.  Believe it or not, terms like drain pan and jug can be regional, especially if you have some workers that weren't originally from the US. 

Then again I'm a programmer, and we have our own issues.

I'm sure you are used to having subsets of the same name as a programmer. Technicians tend to need to be handed terms or they make up their own thing, which is funny because we deal with regional terms as part of our training problems. One of our training technicians just recently got called out for referring to epoxy as "Wet tape". There are references in our tech manuals to attaching cabling using "batmen" thanks to regional lingo.

The problem in this case was that they are wildly different things. One is a chemical bottle, similar to a bleach bottle. Another is an internal component and the third is a remote, large metal basin. If they were 3 similar things, I would have been much cooler about calling them the same thing.

A jug for instance is a small hand held measuring device over here.

My advice to you would be call it what it is.

One time I had to travel to set up shop and train some people due to a dept being relocated to different city.  The job was basically just repackaging items from bulk for individual sale.  Had a woman who insisted on referring to everything as a "unit".  "Put a gauge and a pack of hardware in the plastic shell, then insert that into the box and put a label on it". She'd reply "so I take this unit and that unit and put it in this unit".  It was even more weird when she announced that she ran out of units and then had to further explain which unit she was talking about.  She would also ask whether she should use this unit or that unit while holding up identical  boxes at a distance.  I don't know if she was trying to sound technical or had worked in a factory where they called every damn thing units.

in a failsafe system, to differentiate NO data from ZERO data.
because if you have a sensor failure or disconnect, the input reads continuously low, you need to be able to differentiate that..

00000000 = no data incoming opposed to it having an actual value of zero, otherwise on failure the system would continue to operate as if the value was "zero" instead of halting.


so you can't count from "zero". so you need to count from one.

00000001 = 0
00000010 = 1
00000011 = 2
.
.
.
11111110 = 253
11111111 = 254

but knowing this, leads to some interesting conversations with people who have no idea.

"what is the current data of the X sensor?"

"nothing"

"nothing or ZERO"

"I don't know... it's nothing it's showing nothing"

"so it showing as blank?"

"no it has 3 zeros"

Most do, you are correct, but lilshawn is also correct.... especially on older systems you'll see data similar to what he is saying. 

I know the fact that, sensors aside, the opposite is true and most programmers consider "0" a "1" which confuses the heck out of normal people.  We don't waste data space and properly defined numeric variables default to 0, so in an array or enumeration, 0 is just the first selection of data.  Strangely enough, where we dig around in INI files and various text based configuration files in this hobby, we are all used to starting with 0, so even if you aren't a programmer you have a leg up on the "normies".

And "region" always plays in, no matter what you look at.  That container may be a jug to everyone, or maybe it's a pitcher.  And in programming, depending on what language you are working in (i.e. what "region" of programming you are in), zeros and nulls may be the same, or may not.  Heck, even within one language it may be different depending on the situation.  Zero and Null can both be false, or a zero can be true.  And a zero and a one can both be true, or one could be false and one true.  :dizzy: 

BTW, even google doesn't know what a proper jug is.  Google "jug" and you get a bunch of pictures of pitchers.  A jug is what moonshine came in before they started using jars.   :cheers:

Lol!  Doctors and Engineers seem to always think they are the only ones who understand. 

I will admit, I have been on both sides of this.  I've come up with solutions to complicated problems that people ignore, thinking they have an easier solution simply because they don't understand the underlying issues or the damage they are inadvertently doing with their shortcut.  And I have been schooled by people who are otherwise looked at as idiots when they come up with a solution to a problem that is orders of magnitude simpler than my solution as well as more effective.

In an engineers eyes, when you solve a problem or build something that works without their help, you just got lucky.  Because as you just said, there is no way any of us non engineers have more than a superficial understanding of why things are the way they are. 

For me, my greatest regret is having studied physics for several years in high school and college.  I was so much happier when I didn't have a clue how the world really worked.

Regardless of whether the shares were his or not, you can't lie to investors or potential investors about valuations.  That's considered fraud.  And if you're considered an insider by the SEC, that's a violation of federal law.

Thanks for making my point.  Ken Lay - guilty and died before being sentenced.  Skiling went to prison as did Fastow. 

Same thing with Worldcom/MCI and Bernie Ebbers, prison.  Madoff was different with the ponzi scheme, but he was charged with fraud also.

blows my mind how someone gets out of prison for what he did and ends up at a legit job making more money most likely than honest people who haven't been in prison who could do that job and then he goes for the fast money scheme.

they make tv shows and movies about guys like this.
they are usually depicted as having someone in desperate need of therapy.

I'm trying to explain that previous US governments allowed stock manipulation, and now its apt to punish those who follow in their foot steps.  I'm finding out that the geriatrics and young folk alike are having a hard time grasping this historical aspect.

There seems to be this strange moral loophole for some people that seem to think it's ok for them to do a bad thing just because someone else did the same bad thing.   I assure you that is not the case.   The US government does shady ---steaming pile of meadow muffin--- all the time and it is wrong.   That doesn't warrant justification for private citizens to do the same wrong thing.

It didn't get messy.  People here like to get over enthused.  Were are not all innocent of being a bit naughty.  I went two miles over the speed limit on the freeway a couple of years ago.  Last year I got stopped for doing 40 in a 45 MPH.  I asked the policeman if I should be looking more at the road or the speedometer.  It got comical after that.  I now have a license plate holder that says I go slow. lol

Well David Foley created the first multi arcade game emulator for commercial purposes before MAME arrived.  He tried to take the MAME trademark which was naughty and everything seemed to go down hill after that.
Selling game packs he might have owned or licensed got him in hot water and he paid his dues.  Maybe he got some bad advice from inside.

Now he is suspected of allegedly inflating stock pricing.  Which is a serious no no.  I know a few people who has lost their collective BTC bottoms because of pump and dump, and nobody got arrested for that last little caper. So it is not clear cut and all apples and oranges.  Did anyone else profit from the pump?  What about the dump?  Oooh BTC is $47K at the moment...

What about Foley's alleged Pump.  Were they all losers?

I read the indictment and the case looks flimsy.  If the first part fails then the rest of the indictment fails also.  There are no mention of whom he allegedly defrauded. There is no current valuation of said companies.  Looks like a federal fishing trip.

Remember we are all innocent until proven guilty.  Usually its the other way around.
